(ii) Airline shipments additional $175 for delivery to airline plus COD from Airline. e. Contract Live Foal Guarantee: This is a live foal contract on the following basis: a. A live foal is one that stands and nurses within 4 to 8 hrs of foaling. b. An appropriate nutrition program as well as a mineral supplement, including all shots recommended by your veterinarian must be adhered to throughout gestation. c. Mare must be at an appropriate body condition score throughout gestation and there must be due care taken at time of foaling. d. In the event of a dead foal, verbal notification must be given within 24 hours and a veterinary certificate must be issued and forwarded to Klondike Victory Farm within 10 days. e. Once the above criteria are met, a return breeding will be given; this return must be used within 2 breeding seasons. f. Should the Stallion die, sell, or become unfit for breeding, then the mare owner may use one of the other stallions who stand at Klondike Victory Farm. If the mare owner chooses not to use one of the other stallions then this contract is null and void. g. If the above named mare dies or becomes unfit to carry a foal to term, during the breeding season then the Mare Owner may substitute another mare that is agreed to by both the Mare Owner and Stallion Owner. 3. Mare Care (on-site) a. Mare must be up to date on shots (Eastern/Western influenza, Rhino, West Nile and Tetanus) and a current Coggins Test is required. b. In the event of an emergency, if a veterinarian or farrier is required for mare or foal, these services will be at the mare owner's expense. c. Mare care is $17 per day without foal to a maximum of $475 per month -- $25 per day with a foal to a maximum of $675 per month. Other Klondike Victory Farm requires 24 hours advance notice for shipping semen as well as when the Mare Owner wishes to bring or remove their mare(s) from the farm. Waiver of Liability: It is understood that Klondike Victory Farm, its owners, employees, veterinarians, and guests shall not be liable for any injury, escape, disability, or death of any horse on its premises. The mare owner's signature on this contract attests to the fact that the owner has read and understood all the terms outline herein and accepts this contract as legal and binding. This contract constitutes the entire agreement between the parties. No other agreements, whether verbal or implied are included. This contract is made and entered into, in the province of Alberta, regardless of the manner of solicitation, and shall be interpreted, enforced and transacted within said province under the laws of the Province of Alberta and the Country of Canada.
