The Song of Roland (French: La Chanson de Roland) is an epic poem based on the Battle of Roncevaux in 778, during the reign of Charlemagne. It is the oldest surviving major work of French literature and exists in various manuscript versions, which testify to its enormous and enduring popularity in the 12th to 14th centuries. The date of composition is put in the period between 1040 and 1115: an early version beginning around 1040 with additions and alterations made up until about 1115. The final text has about 4,000 lines of poetry. The epic poem is the first and, along with The Poem of the Cid, one of the most outstanding examples of the chanson de geste, a literary form that flourished between the 11th and 15th centuries and celebrated legendary deeds. Donald Trump was elected President of the United States while promising to build a wall on the Mexico border, and in Europe, the international movements of migrants and refugees have sparked fierce discussion about whether and how countries should restrict access to their territory by erecting physical barriers. Virtual walls are also built and crushed at increasing speed. In the post-9/11 era there is a greater danger from so-called ""transnational non-state actors”, and computer hacking and cyberterrorism threaten to overwhelm our technological barriers. not yet availableDie Arbeit befasst sich mit Abweichungen vom Deutschen Corporate Governance Kodex und von § 161 AktG als Pflichtverletzung im Sinne der Untreue und soll insbesondere zur Klärung der Rechtsnatur dieses aktiengesellschaftsrechtlichen Regulierungsinstruments, welches in unserer Rechtsordnung seinesgleichen sucht, beitragen. Aus strafrechtlicher Perspektive ganz in den Mittelpunkt gerückt wird hierbei das Pflichtverletzungsmerkmal des § 266 StGB im Kontext der Organuntreue, welche Rechtsprechung und Wissenschaft zunehmend beschäftigt. Vertieft nachgegangen wird dabei der Frage, inwieweit der Untreuetatbestand zivilrechtsakzessorisch ist. Außerdem wird untersucht, ob jeder Verstoß gegen die aus §§ 93 Abs. 1 S. 1, 116 S. 1 AktG folgende Legalitätspflicht der Organmitglieder von Aktiengesellschaften auch eine Pflichtverletzung im Sinne der Untreue darstellt.
