This recusal may require the transfer of this matter to another county. As we have seen throughout our legal history, and most recently with the initial prosecution, or rather failure to prosecute, of the individuals that killed Mr. Ahmaud Arbery, a transfer can be used to shield individuals from prosecution. As members of the Fulton and Atlanta House and Senate Delegations, the Georgia House Democratic Caucus leadership, and the Georgia Legislative Black Caucus, we want to ensure that Mr. Rayshard Brooks’ family and the Spelman and Morehouse students receive justice. We expect your office is equally concerned about the pursuit of justice. We also hope you join us in protecting the appearance of fair and just prosecution in Georgia, so that all Georgians know they are protected by the rule of law. Fulton County is the largest county in Georgia with one of the most diverse populations. To achieve justice, we strongly urge you to transfer this matter to another large and diverse county so this matter can be prosecuted by a district attorney elected by a similar population and demographics. Further, we can alleviate the victims’ and their families’ enduring stress and trauma by keeping these cases close to their communities, where the victims and their families can receive continued support from their loved ones and neighbors. Transferring to a similarly large and diverse county near Fulton County will ensure a fair and just prosecution, while also reassuring Georgians that our justice system is impartial. The victims and their families, along with the public, need and deserve to have faith in our judicial system. Thank you for your immediate attention to this matter.
