1 of 4 Charter Rights in the Age of COVID-19 Tyranny and Totalitarianism • Lockdowns: Affected Charter sections: 2, 7 and 15 Fundamental 2. Everyone has the following fundamental freedoms: freedoms (a) freedom of conscience and religion; (b) freedom of thought, belief, opinion and expression, including freedom of the press and other media of communication; (c) freedom of peaceful assembly; and (d) freedom of association. Assert your rights: “My open business (or place of worship) (or presence at the open business or place of worship) is a protest against our unconstitutional lockdowns. I exercise my rights under section 2 of the Charter: the freedom of conscience, (religion), thought, belief, opinion, expression, peaceful assembly and association.” Life, liberty and 7. Everyone has the right to life, liberty and security of the person security of person and the right not to be deprived thereof except in accordance with the principles of fundamental justice. Assert your rights: “My open business (or place of worship) (or presence at the open business or place of worship) is a protest against our unconstitutional lockdowns. I have the right to make a living (or to buy, sell, participate in society, or to worship), and to my own life, liberty and security. I have the right to fundamental justice and I claim it.” Equality before 15. (1) Every individual is equal before and under the law and has the and under law right to the equal protection and equal benefit of the law without and equal discrimination and, in particular, without discrimination based on protection and race, national or ethnic origin, colour, religion, sex, age or mental or benefit of law physical disability. Assert your rights: “I and all other small business owners (or places of worship) am not being treated equally under the law. I am being extremely disadvantaged by the lockdowns. I have been robbed of my dignity and the ability to make a living.” 2 of 4 • Forced testing: Affected Charter sections: 2, 7 and 8 Assert your rights: “I exercise my rights under section 2 of the Charter: the freedom of conscience, thought, belief, opinion, expression, and association. I don't believe in forced testing of any kind.” Assert your rights (s. 7): “I have the right to life, liberty and security. I have the right to fundamental justice and I claim it. I do not consent to having a test of any kind.” Search or seizure 8. Everyone has the right to be secure against unreasonable search or seizure. Assert your rights: “I do not consent to a seizure of any of my bodily substances, fluids or samples by way of testing or any other means.” • Forced vaccination: Affected Charter sections: 2 and 7 Assert your rights: “I exercise my rights under section 2 of the Charter: the freedom of conscience, thought, belief, opinion, expression, and association. I don't believe in forced vaccination. Period.” Assert your rights (s. 7): “I have the right to life, liberty and security. I have the right to fundamental justice and I claim it. I make my own healthcare choices. I do not consent to being vaccinated.” • Travel restrictions outside of Canada: Affected Charter sections: 2, 6(1) and 7 Assert your rights: “I exercise my rights under section 2 of the Charter. I have the freedom to associate with friends and family outside of Canada, and to return to my home.” Mobility of 6. (1) Every citizen of Canada has the right to enter, remain in and citizens leave Canada. Assert your rights: “I have the right to legally travel to and from Canada as I see fit.” 3 of 4 Assert your rights (s. 7): “I have the right to life, liberty and security. I have the right to fundamental justice and I claim it. I may not be restricted in my movement or ability to enter or leave Canada.” • Travel restrictions or checkpoints inside of Canada: Affected Charter sections: 2 and 7 Assert your rights: “I exercise my rights under section 2 of the Charter. I have the freedom to associate with friends and family anywhere within my province and country, and to return to my home.” Assert your rights (s. 7): “I have the right to life, liberty and security. I have the right to fundamental justice and I claim it. I may not be restricted in my movement or ability to travel. Period.” • Forced quarantine without symptoms: Affected Charter sections: 2, 7, 8, 9, 10, 11(c) and (d), and 15 Assert your rights: “I exercise my rights under section 2 of the Charter. Forced quarantine without an illness or symptoms is abhorrent, oppressive and abusive in a free and democratic society.” Assert your rights (s. 7): “I have the right to life, liberty and security. I have the right to fundamental justice and I claim it. I have no illness or symptoms of any illness. I do not consent to a quarantine or detention of any kind.” Assert your rights (s. 8): “I do not consent to my removal or seizure, or the removal or seizure of any of my property. I do not consent to any searches.* I am not sick. I have no symptoms of any illness.” *Limited searches of property is permitted when crossing the border Detention or 9. Everyone has the right not to be arbitrarily detained or imprisoned. imprisonment Assert your rights: “A forced quarantine without illness or symptoms is an arbitrary detention.” Arrest or 10. Everyone has the right on arrest or detention detention (a) to be informed promptly of the reasons therefor; (b) to retain and instruct counsel without delay and 4 of 4 to be informed of that right; and (c) to have the validity of the detention determined by way of habeas corpus and to be released if the detention is not lawful. Assert your rights: “Are you detaining me or am I free to go?” If not released: “This is completely illegal. I want my lawyer. I will not talk to you any further.” Proceedings in 11. Any person charged with an offence has the right criminal and penal matters (c) not to be compelled to be a witness in proceedings against that person in respect of the offence; (d) to be presumed innocent until proven guilty according to law in a fair and public hearing by an independent and impartial tribunal Assert your rights*: “I will not talk to you any further. I am not sick. I have no symptoms.” *Section 11 rights do not apply when crossing the border unless one is charged with an offence. Assert your rights (s. 15): “I am not sick. I have no symptoms. I am a regular person. I do not belong to a favoured political- or wealthy, famous, or elite- class of citizens. I am not being treated equally under the law. I am being extremely disadvantaged by a forced quarantine.
