Purpose This Agreement records the terms agreed between the Rider and Driver where the Rider requests assistance or services that go beyond the ordinary transportation service. The parties acknowledge that the Driver's primary service is the transportation of the Rider between the agreed pick up and destination points. The Driver is not obliged to provide personal assistant, porter, mover or other physical labour services merely because the Rider has paid the transportation fare. 2. Additional Services The Rider has requested the following additional service: The Driver has voluntarily agreed to provide the additional service. Any additional fee agreed between the parties is: Additional service fee: S$_________________________ The additional service fee is separate from the ordinary transportation fare. The Driver may refuse, suspend or stop the additional service at any time if the Driver reasonably considers that performing it may be unsafe, unlawful or beyond the Driver's physical capabilities. 3. Luggage and Property The Rider remains responsible for identifying the luggage, goods or property requiring assistance and for providing accurate information concerning their size, weight and nature. The Rider must inform the Driver of any item that may be unusually heavy, bulky, fragile, unstable or otherwise hazardous to handle. The Rider must not require or pressure the Driver to lift, carry, load or unload any item that the Driver does not reasonably consider safe to handle. 4. Risk Acknowledgement The Rider acknowledges that physical assistance involving lifting, carrying, loading or unloading property may expose the Driver to risks including, without limitation, muscular strain, back injury, falls, cuts, crushing injuries or other physical injury. The Rider acknowledges these risks and agrees that the Driver is providing the additional service voluntarily. 5. Responsibility for Rider's Requests and Instructions The Rider agrees to exercise reasonable care when requesting or directing the Driver to perform an additional service. Where the Driver suffers loss, injury or expense as a result of the Rider's negligent, misleading or unsafe instructions, requests or conduct, the Rider may be responsible for the resulting loss or expense to the extent provided by applicable Singapore law. Nothing in this Agreement makes the Rider automatically liable for every injury or loss suffered by the Driver. 6. Medical and Other Expenses Where the Rider is legally responsible for an injury, loss or expense arising from the Rider's conduct or instructions, the Rider agrees to compensate the Driver for the reasonable and properly documented losses and medical expenses recoverable under applicable law. This provision does not constitute an unconditional agreement by the Rider to pay all medical expenses regardless of cause. The parties acknowledge that responsibility for an accident or injury will depend on the circumstances of the incident and applicable law. 7. Driver's Own Conduct Nothing in this Agreement removes or transfers responsibility for the Driver's own negligent or unlawful conduct. The Driver remains responsible for complying with all applicable laws, licensing requirements, road traffic requirements, insurance requirements and other regulatory obligations. 8. No Waiver of Statutory Rights Nothing in this Agreement is intended to exclude, restrict or waive any right, liability or obligation that cannot lawfully be excluded, restricted or waived under Singapore law. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue to operate to the extent permitted by law. 9. No Obligation to Provide Additional Physical Labour The Rider acknowledges that payment of the ordinary transportation fare does not, by itself, require the Driver to provide additional physical labour. The Driver may decline any additional service without penalty. 10. Evidence of Agreement The parties should sign this Agreement before the additional service begins. Where practical, the parties should retain a copy or photograph of the signed Agreement and record the agreed additional service and additional fee. 11. Acknowledgement By signing below, both parties confirm that they have read and understood this Agreement and voluntarily agree to the additional service described above.
