T&C T's Removals & Storage Terms & Conditions Introduction These Terms & Conditions outline the rights, obligations, and responsibilities of all parties involved in this Agreement. "You" or "Your" refers to the Customer, and "We," "Us," or "Our" refers to T's Removals & Storage. These terms may be varied or amended only by prior written agreement. Please note that Clauses 8, 9, and 10 limit or exclude Our liability for loss or damage. We recommend that You arrange comprehensive insurance to cover Your goods during transit and storage. We can arrange insurance upon request, which will be separate from this contract and subject to the terms and conditions of the policy. 1. Our Quotation 1.1 Our quotation does not include insurance, cancellation/postponement waivers, customs duties, port charges (including demurrage, inspections, or any other fees or taxes payable to government bodies), unless specifically stated. 1.2 The quotation is valid for twenty-eight (28) days from the date of issue. Additional charges will apply in the following circumstances: 1.2.1 If work does not commence within twenty-eight days of acceptance. 1.2.2 If the delivery from storage does not occur within six months from the date of the quotation. 1.2.3 If costs change due to currency fluctuations, taxation changes, or changes in freight, fuel, ferry, or toll charges beyond Our control. 1.2.4 If the work is carried out outside normal hours (08:00-18:00) or on weekends or public holidays, at Your request. 1.2.5 If We have to collect or deliver goods above the ground floor or to floors above the first floor. 1.2.6 If You or Your agents request collection or access to Your goods while in storage. 1.2.7 If We supply additional services, including moving or storing extra goods not previously agreed upon. 1.2.8 If the premises are not adequate for free movement of goods, requiring additional equipment or alterations, or if the approach to the property is unsuitable for Our vehicles. 1.2.9 If We have to pay parking or other fees or charges in order to carry out the services. 1.2.10 If delays or events outside Our reasonable control extend the time required to complete the agreed work. 1.2.11 If We agree in writing to increase Our limit of liability as set out in Clause 8.1 prior to commencing work. 1.3 You agree to pay any reasonable charges arising from the above circumstances. 2. Work Not Included in the Quotation 2.1 Unless specifically agreed upon in writing, We will not: 2.1.1 Dismantle or assemble furniture or equipment. 2.1.2 Disconnect, re-connect, dismantle, or re-assemble appliances, fixtures, or fittings. 2.1.3 Take up or lay fitted floor coverings. 2.1.4 Move items to or from a loft unless properly lit, floored, and with safe access. 2.1.5 Move or store items excluded under Clause 4. 2.2 Our staff are not authorised or qualified to carry out such work, and We recommend You employ a qualified professional. 3. Your Responsibility 3.1 You are responsible for: 3.1.1 Arranging adequate insurance cover for goods submitted for transit and/or storage. 3.1.2 Obtaining all necessary documents, permits, and licences for the removal. 3.1.3 Paying for any parking or meter suspension charges incurred by Us. 3.1.4 Being present or represented throughout the collection and delivery of the removal. 3.1.5 Ensuring that inventories or relevant documents provided by Us are signed by You or Your representative. 3.1.6 Ensuring that nothing is left behind or taken away in error. 3.1.7 Protecting goods left in unoccupied premises. 3.1.8 Stabilising all appliances or electronic equipment prior to removal. 3.1.9 Emptying, defrosting, and cleaning refrigerators and freezers. 3.1.10 Ensuring all domestic and garden appliances are clean and dry. 3.1.11 Providing Us with a correct and up-to-date contact address and telephone number during the removal. 3.2 Other than due to Our negligence or breach of contract, We will not be liable for any loss or damage arising from failure to discharge these responsibilities. 4. Goods Not to Be Submitted for Removal or Storage 4.1 Unless previously agreed in writing, the following items must not be submitted for removal or storage and will not be moved or stored by Us: 4.1.1 Dangerous, damaging, or explosive items. 4.1.2 Jewellery, precious stones or metals, money, deeds, securities, or similar items. 4.1.3 Goods likely to encourage vermin or cause contamination. 4.1.4 Perishable items or those requiring a controlled environment. 4.1.5 Animals, birds, fish, reptiles, or plants. 4.1.6 Goods requiring special licences or government permissions for export or import. 4.1.7 Prohibited or stolen goods, drugs, or pornographic material. 4.2 If such goods are submitted without Our knowledge, We will make them available for Your collection and may apply for a court order to dispose of them if not collected within a reasonable time. 4.3 If these goods are submitted to us at any stage, all liability for any issues caused will be upon you, the customer. 5. Ownership of the Goods 5.1 By entering into this Agreement, You guarantee that: 5.1.1 The goods are Your own property, free of legal charge, or 5.1.2 You have full authority from the owner to enter into this Agreement and have made the owner aware of these terms and conditions. 5.1.3 You will provide Us with the owner's details if they obtain an interest in the goods. 5.1.4 You will indemnify Us against any claim for damages or costs if either statement in 5.1.1 or 5.1.2 is untrue. 5.2 If You wish to transfer responsibility for this Agreement to a third party, You must notify Us in writing. 6. Charges If You Postpone or Cancel the Removal 6.1 If You postpone or cancel this Agreement, We reserve the right to charge a reasonable fee based on the notice period: 6.1.1 More than 10 working days before the removal: No charge. 6.1.2 6-10 working days before the removal: Up to 30% of the removal charge. 6.1.3 Less than 6 working days before the removal: Up to 60% of the removal charge. 6.1.4 Within 48 hours of the move: Up to 75% of the removal charge. 6.1.5 On the day the work starts or after commencement: Up to 100% of the charges. 7. Payment 7.1 Unless otherwise agreed in writing, payment is required in full by cleared funds before the completion of the removal or storage. We reserve the right to refuse to commence work until payment is received. 7.2 In default of payment, interest will be charged daily at 4% above the Bank of England base rate. 8. Our Liability for Loss or Damage 8.1 We limit Our liability to £40 per item lost or damaged due to Our negligence or breach of contract. 8.2 For international removals, We will only accept liability for loss or damage caused by Our negligence while the goods are in Our physical possession. 8.3 We do not accept liability for goods confiscated, seized, or damaged by Customs Authorities or other Government Agencies unless due to Our negligence. 9. Damage to Premises or Property Other Than Goods 9.1 We will only be liable for damage to premises or property caused by Our negligence and will be limited to making good the damaged area only. 9.2 We will not be liable for damage caused when moving goods under Your instruction against Our advice. 10. Exclusions of Liability 10.1 We shall not be liable for loss or damage caused by fire, explosion, or other events outside Our control, unless due to Our negligence. 10.2 We shall not be liable for delays caused by events outside Our control. 10.3 We shall not be liable for loss, damage, or failure to produce goods due to: 10.3.1 Normal wear and tear, natural deterioration, leakage, or perishable items. 10.3.2 Moth, vermin, or infestation. 10.3.3 Cleaning, repairing, or restoring unless arranged by Us. 10.3.4 Atmospheric conditions such as dampness, rusting, or corrosion. 10.3.5 Goods in containers not packed or unpacked by Us. 10.3.6 Electrical or mechanical derangement of equipment unless externally damaged. 10.3.7 Pre-existing defects or inherent defects in goods. 10.3.8 Perishable items or those requiring a controlled environment. 10.3.9 Loss of structural integrity of furniture
