1 TICKETING TERMS AND CONDITIONS GENERAL • $5 of the ticket value will be donated to The KFC Youth Foundation. To find out more about the charity visit https://www.kfc.com.au/kfc - youth - foundation • Tickets purchased through Moshtix are distributed via email prior to the festival. The Moshtix platform provides an opportunity for you to provide your email address and we will deliver your ticket to that email address. You are not required to print your ticket(s) you can present the electronic PDF version of the ticket to be scanned directly from your mobile or tablet device. If you have not received yo ur tickets within 48 hours of the E vent you can log in to your Moshtix account to either re - send, download a copy, or contact Moshtix support by submitting a request https://tixsupport .Moshtix.com.au/hc/en - us/requests/new or by email help@tixsupport.com • It is the responsibility of the ticket holder to not share the digital ticket as multiple copies of the same ticket will not be accepted, and you may be refused entry if the ticket has already been used • We reserve the right to charge a fee for the replacement of lost, destroyed, or stolen tickets. • You will be issued with a wristband after you have shown your valid digital ticket to staff at the gate • I f you have Print at Home E - Ticket(s) you will be able to update the name on your Print at Home E - Ticket(s) although there may be a charge for any name change. Please visit www.moshtix.com.au to update any name change. REISSUE AND RESALE • All bookings and ticket purchases are transferrable only via Moshtix. The ability to reissue (change the name on your ticket) is available for a $3 fee per ticket. To use this service, log into your Moshtix account after you have purchased the ticket(s). Ticket reissues will be available, up to 48 hours prior to the door/gate opening time. The new attendees name, email and date of birth may be required when reissuing a ticket. There will be a maximum of two (2) reissues permitted per ticket. REFUNDS • Refunds will be made using the same means of payment as you used for the initial purchase via Moshtix. • Under the LPA Code of Practice, The Event Organiser is not required to offer a refund, exchange, or cr edit if: o A ticket holder is well and does not wish to attend the Event due to fears of exposure to Coronavirus (COVID - 19); or o A ticket holder is unwell and does not attend the Event (other than due to Coronavirus (COVID - 19) illness or symptoms which can b e proven by display of a positive COVID - 19 test result); or o A ticket holder is from a group at a higher risk of Coronavirus (COVID - 19); or o A ticket holder is denied entry into the Event for reasons which were disclosed to the ticket holder in the ticket te rms and conditions at the time of sale. For example, these reasons may include (but not be limited to) non - compliance with mandatory mask wearing or unwillingness to provide personal contact information when requested; or 2 o The ticket holder attends the per formance and subsequently leaves part way through due to feeling unwell. • In the event of a mandated requirement to self - isolate and/or mandated border closures, ticket holders may request a refund, exchange, or credit if: o R easonable evidence proving restri ction to travel due to Government order is provided o Requests are made within 14 days from the date displayed on your entry ticket o The Event Organiser may reserve the right to refuse remedy if: ▪ 1. There is no current Government order restricting entry into NSW and/or without having to mandatory quarantine, at the time of the festival ▪ 2. It cannot be proven by Government order that you were restricted to travel into NSW or at the time of the fes tival. ▪ 3. Requests are not made within 14 days from the date displayed on your entry ticket • If your reason for not attending the Event is due to COVID - 19 illness or symptoms and/or in the event of a mandated requirement to self - isolate and/or mandated bo rder closures and can be supported with the evidence of COVID - 19 positive test result and/or sufficient evidence proving your inability to travel due to Government order at the time of the festival, you may submit a request for a refund. Refund requests ma y only be submitted within 14 days from the date displayed on your entry ticket. • Subject to any statutory rights of refund (including, without limitation, the provisions of the Australian Consumer Law), if the E vent takes place, then generally there is no right to a refund or exchange, including where a ticket holder cannot attend because of adverse weather conditions. CANCELLATION O F EVENT • The Event Organiser reserve s the right to cancel the Event for any reason. • If the E vent is cancelled in full (and not rescheduled), your order will be cancelled, and you will be refunded the price of your ticket(s) (unless required by Australian Consumer Law, any handling fee and de livery fee will not be refundable, where this is specified in the E vent information for the E vent). RESCHEDULING OF EVENT • If the E vent is unable to proceed on the advertised date or location, t he Event Organiser reserves the right to reschedule the Even t and offer an exchange to the rescheduled Event • If the Event is rescheduled, ticket s will be valid for the new date. Ticket holders will be contacted directly via email by Moshtix and presented with the option to: (a) exchange tickets for the reschedule d Event ; or (b) request a refund. • You will need to email Moshtix requesting a refun d within 4 weeks of receiving notification of the rescheduling of the Event • Provided you email Moshtix within 4 weeks to request a refund , you will obtain a full refund of the sale price of your tickets (unless required by Australian Consumer Law, any handling fees and delivery fees will not be refundable, where this is specified in the information for the Event ). 3 • If you do not email Mosht ix requesting a refund within 4 weeks of the email notification of the rescheduling of the Event being sent to you , you will not be refunded (unless required by applicable law). • For the avoidance of doubt, no refunds will be available until the new date i s announced (which will be done within a reasonable time) to allow the Event Partner time to make arrangements for the rescheduled Event CONDITIONS OF ENTRY • This is a licensed Event and entry is restricted to over 18 year old’s only • Any minor under 15 years old cannot enter except when accompanied by a responsible adult or guardian in accord ance with the Liquor Act • Photo ID is required for age and name verification and for entry by e - ticket holders or on - demand The only forms of valid photo ID that will be accepted are; Current Australian Driver’s License, Current Passport, Current state issued photo or proof of age card, school card or International driver’s licenses are valid forms of identification. • Your ticket must be exchanged for a wristba nd on entry to the Event and must be worn at all times for the duration of the Event. Once a wristband is removed it becomes void. Stretched or damaged wristbands will not be replaced • The right of admission is reserved and is subject to the Event organise r and the venue's terms of admission, copies of which are available online and from t he Event Organiser on request • No violence will be tolerated and attendees will be removed from the E vent in the Event Organiser’s sole discretion. • There are no pass outs • The Event Organiser reserves the right to inspect and search all persons, bags and containers are subject to a full search at entry to ensure the safety of patrons. • Persons entering the Event maybe monitored and recorded by Closed Circuit Television (CCTV) • All patrons must have a valid ticket, pass or other authorised and approved means to enter the Event. • No alcoholic beverages can be taken into or leave the Event. • Smoking is not permitted e xcept in the designated smoking area • When leaving the Event please have consideration for our neighbours and keep noise to a minimum • Prohibited items will be confiscated except illegal drugs, which will be handed over to police. • The Event Organiser reser ves the right to refuse entry to any patron without appropriate identification. • You will not be able to purchase or consume alcohol unless you have valid photo ID and of legal age. • In the case of an emergency evacuation or situation, please follow all of ficial directives. • You may be filmed at this event • The Event Organisers accept no responsibility for property lost at the E vent. • Familiarise yourself with first aid locations • Anyone found in unauthorized areas of the E vent will be evicted from the Event. • Anyone found climbing trees and /or garden beds will be evicted from the Event. 4 LICENCE, EJECTION AND CANCELLATION; NO REDEMPTION VALUE • The Event Organiser reserves the right, without refund of any amount paid, to refuse admission to, or eject, any person whose conduct the Event Organisers or their agents, employees or contractors deems to be disorderly, who uses vulgar or abusive language or who otherwise fails to comply with these Terms & Conditions. A ticket is a revocable licence and any breach of these Terms & Conditions will terminate your licence to attend the event without refund or compensation. • GLASS, ALCOHOL, WEAPONS, ILLEGAL SU BSTANCES, or any item the Event organizers consider may be used in an illegal or offensive manner may be confiscated. Refusal to consent to a search WILL prevent entry to the Event, without refund. All bags/containers will be subject to a full search. The festival is licensed – do not bring alcohol with you – any prohibited items found will be confiscated and not returned • Entry is at own risk and the right to refuse entry is reserved. The Event Organiser or venue shall not be held liable for any loss, inju ry or damages sustained entering on the site – to the extent allowed by the law • Entry may be refused if tickets are damaged or defaced in any way or are not purchased through an authorized point of sale. Do not share your ticket barcode it may prevent ent ry. The Event Organiser reserves the right to deny admission to the Event to any person holding a ticket that appears to have been tampered with, counterfeited, or duplicated. Anyone found on site without a valid wristband or accreditation will be deemed a s trespassing and will face prosecution from NSW police • Entry may be refused if the ticket buyer does not obey to all government regulations regarding the E vent PROHIBITED/BANNED ITEMS • Alcoholic beverages. • Illicit drugs. • Full or partly full plastic bottles of water or soft drink etc. • Ice chests or eskies • Flares, fireworks, or explosives • Laser pointers. • Knives, guns or other dangerous weapons including potential missiles. • Skateboards, scooters, rollerblades or bicycles. • Glass or breakable con tainers. • Horns, whistles and megaphones or other musical instruments that may cause a nuisance • Cans or metal containers. • Chairs (folding, portable, camping). • Video and audio recording devices including GoPros (other than mobile phones). • Professional still cameras. • Umbrellas. • Selfie sticks. • Any other items considered illegal or dangerous. • Any political, religious or race - related materials • Strictly no animals (with the exception of service or assistance animals, such as guide dogs ) 5 PATRON HEALTH DECLARATION All attendees of t he Event must commit to stopping the spread of COVID - 19. The primary ticket purchaser agrees that they nor anyone in their group will attend the E vent if, at the time of the E vent, they are unwell or subject to a self - quarantine or self - isolation period. • If you an d/or the members of your group are unwell, or have experienced cold or flu like symptoms within the last 14 days, and/or you or any members of your group have been in contact with someone with COVID - 19 and/or have returned from interstate or overseas and h ave been advised to isolate, we ask that you do not attend the Event until you are well again and/or have been released from isolation and cleared by COVID - 19 testing. • If you are attending the Event as part of a group, as the primary ticket purchaser, you are responsible for knowing the contact details of all attendees in your group. In the event you are contacted directly by the Government, including the Department of Health for the purpose of contact tracing, you must: a) make the contact details of you and your group available and b) contact each member of your group, and request that they provide their contact details directly to the relevant health authorities. • The Event Organiser and v enue management have a right to require COVID Safe App check in an d not allow entry or evict patrons who do not check in and/or are displaying COVID - 19 symptoms. If an eviction from the Event occurs, the ticket holder and/or accompanying group will not be entitled to a refund or exchange. SAFETY, ILLNESS, INJURY AND OTH ER LOSS – LIMITATION OF LIABILITY Risk of injury or illness • Risks of injury or illness associated with attending the E vent may include (without limitation) (a) Transmission of COVID - 19 and other infectious diseases which may be transmitted in any environment w here people gather (including at events); and (b) Miscellaneous objects flying into spectator areas during events. • Although reasonable measures will be taken to protect spectators (including COVID - 19 safety measures), injury and illness can occur. To the ext ent permitted by law, the Event Organiser disclaims all liability for any loss, injury or damage to any person (including you) or property at an event (save for death or personal injury caused directly by the Event Organiser’s negligence). Government Heal th Directions • To reduce the above identified risks, you and your guests are required to abide by all government guidance and directives aimed at preventing the transmission of COVID - 19 and other infectious diseases (including guidance and directives which may apply in the State or Territory where the event is held). Safety Protocols • You must also follow al lawful and reasonable directions of the Event Organiser designed to create a safe environment for spectators and you must stay alert at all times befor e, during and after the event. If struck or otherwise injured or distressed, immediately ask an usher for assistance or directions to contact an emergency service. 6 Liability for other losses • Unless required by applicable law, o personal arrangements and expenditure, including travel, accommodation, hospital and other costs which have been arranged by you are at your own risk and the Event Organiser shall not be responsible or liable to you for any wasted or unrecoverable costs o r expenditure in relation to such personal arrangements, even if caused as a result of the cancellation, rescheduling or alteration of the event; o the Event Organiser shall not be responsible or liable to you for any loss of enjoyment or amenity, including where an event has been cancelled, reschedule or altered; o the Event Organiser shall not be responsible or liable to you for (and you will not be entitled to any refund) if admission to the event is refused or revoked at any time as a result of your breach of these terms and conditions; and o the Event Organiser will not be responsible for any personal property taken into the event. Maximum Liability • Where liability cannot be excluded by law (including, without limitation, the Australian Consumer Law), the maximum liability that Moshtix and the Event Organiser will have to you under any circumstances is the face value of the ticket purchased plus any r elevant per transaction handling fee and delivery fee. Nothing in these Terms and Conditions seeks to exclude or limit Moshtix and the Event Partner’s liability which cannot be excluded or limited by law (including, without limitation, the Australian Consu mer Law). CONTACT TRACING • The ticket holder agrees to additional contact tracing on the days of the event by methods provided by The Event Organiser such as the COVIDSafe app. • Should the primary ticket buyer be attending the event as part of a group, the y are responsible for knowing the contact details of all attendees in their group. If they are contacted directly by the Government including the Department of Health for the purposes of contact tracing, they must: o a) make the contact details of their gr oup available to the Government, or o b) contact each member of their group, and request that they provide their contact details to the Government directly. RECORDING AND PHOTOGRAPHING OF THE EVENT BY KFC • You consent to be included in any audio recordings , audio - visual recordings and photographs of the Event created by, at the direction of, or with the authority of the KFC ( Materials ). In the event that you hold any rights in the Materials, without any fee or compensation payable to you, you irrevocably as sign to KFC any and all benefit, right, title and interest in and to the Materials owned, controlled or created by you for KFC to hold and exploit in any context in any and all media now known or later devised absolutely, in perpetuity, throughout the worl d (including for advertising, marketing and promotional purposes whether in respect of the KFC or third parties), free from any claims whatsoever from you. You waive all moral or other similar rights in respect of your performance or participation in the M aterials that you may be entitled to under the laws of any jurisdiction throughout the world in perpetuity. To the extent that the foregoing waiver is not enforceable in any such jurisdiction, you unconditionally and irrevocably consent, for the benefit of everyone throughout the world, to 7 KFC , its licensees and assignees doing or authorising the doing of any act or making or authorising the making of any omission which may infringe your moral rights in respect of the Materials.
