This Investigation does not present a situation in which the Commission, the parties, or the public should expend the time or resources to undertake discovery and trial on the public interest before the presiding Administrative Law Judge (“ALJ”). As detailed herein, issuance of the relief requested will not adversely impact the public health, safety, or welfare conditions in the United States; competitive conditions in the United States economy; the production of like or directly competitive articles in the United States; or United States consumers. To the contrary, it will positively impact the public interest by protecting intellectual property and patent rights and barring the importation of unauthorized displays used as replacement parts that are lower-quality copies of Complainant’s patented products. The requested remedial orders will provide effective relief from the ongoing patent infringement by Proposed Respondents and will address Proposed Respondents’ unfair competition. As the Commission has stated, “[T]he public interest favors the protection of U.S. intellectual property rights by excluding infringing imports.” 1 Accordingly, issuing the requested remedies in this Investigation will serve, not impair, the public interest. I. How the Accused Products Are Used in the United States The Accused Products are certain active matrix organic light-emitting diode (“AMOLED”) display panels and modules that are used as replacement displays, and components thereof, which infringe one or more claims of the Asserted Patents, as further defined in the Complaint herein. Organic light-emitting diode (“OLED”) displays contain pixels made of organic materials that emit 1 Certain Electrical Connectors & Prods. Containing Same, Inv. They are incorporated by original- equipment manufacturers into a variety of devices, such as smartphones, televisions, and computers. Complainant has innovated AMOLEDs that confer numerous advantages such as superior image quality, higher brightness, wider color range, better contrast, faster refresh rates, increased thinness, and lower power consumption. The Accused Products are used to replace the AMOLED display that comes installed in a smartphone or other mobile device, generally following damage to the device. This use does not raise a public interest concern should remedial orders be issued. II. No Public Health, Safety, or Welfare Concerns Relating to the Requested Remedy The requested remedial orders would not adversely affect public health, safety, or welfare in the United States. Specifically, the Accused Products, AMOLED display panels used as replacement displays, are not medical or health devices, are not otherwise health-related, and are not essential for public health or welfare. The proposed remedial orders would not impact the importation of smartphones, tablets, or other end-user devices containing AMOLED displays. Moreover, as explained below, consumers would continue to be able to obtain replacement AMOLED displays if remedial orders issued. III. Complainant Makes Like or Directly Competitive Products that Could Satisfy Consumer Demand Complainant makes like or directly competitive products—indeed, higher quality articles—that it supplies to mobile phone manufacturers who offer repair services to consumers in the United States. Complainant’s products can continue to be supplied to the U.S. market following the issuance of remedial orders. SDC has been a pioneer in AMOLED displays, and its innovation –3– has been largely responsible for bringing this technology to the U.S. market. 2 Consumers would thus still be able to purchase like or directly competitive articles if a remedy issued. IV. Complainant Has the Capacity to Replace the Volume of Articles Subject to Remedial Orders within Commercially Reasonable Time As explained above, SDC is considered the market leader in OLED displays, including in the U.S. market. SDC has the capacity to produce, and does produce, millions of displays each year that utilize the technology of the Asserted Patents. These displays have been used, and can continue to be used, in mobile phone manufacturers’ authorized repair services. Consumer demand for OLED displays would be met within a commercially reasonable period of time through authorized channels. 3 V. The Requested Remedial Orders Would Not Adversely Impact Consumers As stated above, if Proposed Respondents’ infringing products were excluded from the U.S. market, consumers would not be adversely impacted, as sufficient manufacturing capacity exists to assure demand is met for OLED displays used as replacement displays, that could be (and currently are) supplied through authorized channels. In fact, the proposed remedial orders would protect U.S. consumers by excluding sub-standard products from the market. INTRODUCTION 1. Samsung Display Company, Ltd. (“SDC” or “Complainant”) is a pioneer in organic light-emitting diode (“OLED”) display technologies. SDC custom-designs and custom- manufactures OLED displays for mobile devices and other products. Through SDC’s innovations, OLED displays have attained widespread commercial adoption and have become the displays of choice in smartphones, among other applications. 2. OLED displays contain pixels made of organic materials that emit light of a particular wavelength upon the application of electric current. SDC has innovated active matrix OLED displays (known as AMOLEDs) 1 that have largely supplanted liquid crystal displays (LCDs) in applications such as mobile devices due to the numerous advantages they offer, including superior image quality, higher brightness, wider color range, better contrast, faster refresh rates, increased thinness, and lower power consumption. Active matrix OLED displays are now the predominant type of OLED display used in mobile devices, to the point that industry participants often leave out the “active matrix” modifier and refer to the displays in shorthand simply as “OLED displays.” 3. SDC has received widespread recognition and praise for making fundamental contributions to OLED technologies over many years. For instance, the Society for Information Display (“SID”) has awarded SDC with at least four “Display of the Year” awards for its OLED displays and recognized SDC for its development of the first flexible AMOLED display (2014), 1 An “active matrix OLED” (or “AMOLED”) is a type of OLED display in which switching elements (typically thin film transistors) and a storage element (typically a capacitor) are provided for each pixel, in order to allow each pixel to “actively” maintain its state while other pixels are being set to the desired brightness. This type of display contrasts with “passive matrix” OLED displays, which lack such circuitry for each pixel and use, instead, the intersection of two conductive lines to control a pixel. –1– the first bended AMOLED display (2015), the first quad-bended AMOLED display (2017), the first foldable AMOLED display (2020), and the first AMOLED display with “Eco2 OLED” technology that removes the polarizer (2022). 4. SDC’s innovations are protected by patents, including the patents at issue here. Despite the patents covering SDC’s AMOLED display products, SDC has become aware that its designs and technologies are being widely copied in aftermarket displays used as replacement displays for mobile devices. The Proposed Respondents are companies that sell and offer for sale replacement displays that infringe SDC’s patents. 5. SDC requests that the United States International Trade Commission (the “Commission”) institute an investigation pursuant to Section 337 of the Tariff Act of 1930, as amended, 19 U.S.C. § 1337 (“Section 337”), to remedy the unlawful importation, sale for importation, and/or sale after importation of certain AMOLED display panels and modules that are used as replacement displays for mobile devices, and components thereof and infringe valid and enforceable United States patents owned by SDC. 6. The Proposed Respondents are Apt-Ability LLC (d/b/a MobileSentrix); Mobile Defenders, LLC; Injured Gadgets, LLC; Group Vertical, LLC; Electronics Universe, Inc. (d/b/a Fixez.com and Repairs Universe, Inc.); LCTech International Inc. (d/b/a SEGMobile.com); Sourcely Plus, LLC; eTech Parts Plus LLC; Parts4Cells Inc.; Wholesale Gadget Parts, Inc.; Captain Mobile Parts, Inc., DFW Imports LLC (d/b/a DFW Cellphone and Parts); Phone LCD Parts LLC (d/b/a Phone LCD Parts and Parts4LCD); Mengtor Inc.; and Gadgetfix Corp. 7. Upon information and belief, the Proposed Respondents have engaged in unfair acts in violation of Section 337 through, and in connection with, the unlicensed importation into the United States, sale for importation into the United States, and/or sale within the United States –2– after importation of AMOLED display panels and modules that are used as replacement displays for mobile devices, and components thereof (“Accused Products”), which infringe one or more claims of United States Patent No. 9,818,803 (the “’803 Patent”), United States Patent No. 10,854,683 (the “’683 Patent”), United States Patent No. 7,414,599 (the “’599 Patent”), and United States Patent No. 9,330,593 (the “’593 Patent”) (together, “the Asserted Patents”).2 8. SDC owns by assignment the entire right, title, and interest in and to each of the Asserted Patents.3 10. As required by Section 337(a)(2) and 337(a)(3), an industry exists in the United States relating to the Asserted Patents. 11. In the alternative, SDC seeks, as relief, a permanent limited exclusion order, pursuant to Section 337(d), specifically directed to each named Proposed Respondent and its subsidiaries, predecessors, affiliates, agents, successors, and assigns, excluding from entry into the United States all infringing Accused Products. SDC also seeks a permanent cease and desist order, pursuant to Section 337(f), directing Proposed Respondents to cease and desist from activities that include, but are not limited to, offering for sale, selling, importing, transferring, distributing, warehousing inventory for distribution, using, assembling, advertising, marketing, demonstrating, repairing, supporting, qualifying for use in the products of others, testing, or installing the infringing Accused Products. SDC further requests that the Commission impose a bond during the 60-day Presidential review period pursuant to 19 U.S.C. § 1337(e)(1) and (f)(1) covering any importation of infringing Accused Products. II. COMPLAINANT 12. Complainant SDC is a corporation organized and existing under the laws of the Republic of Korea, with its principal place of business at #1, Samsung-ro, Giheung-gu, Yongin- si, Gyeonggi-do, 17113, Republic of Korea. 13. SDC is a pioneer and world leader in the design and manufacture of AMOLED displays, whose track record of innovation in OLED display technologies traces back two decades. In 2007, SDC commercialized the first AMOLED display for a smartphone. SDC supplied the earliest AMOLED displays for smartphones, such as the Nokia N85 and the Samsung i7110, and for many years was the only company to commercially manufacture AMOLED displays. SDC has continued to innovate, and among its more recent innovations is the development of the first flexible AMOLED display. 14. SDC custom-designs and custom-manufactures AMOLED displays that are incorporated into and serve as displays and user interfaces in Samsung Galaxy S series –4– smartphones including at least the Galaxy S9, S9+, S10e, S10, S10+, S10 5G, S10 Lite, S20, S20+, S20 Ultra, S20 FE, S21, S21+, S21 Ultra, S21 FE, S22, S22+, S22 Ultra products (the “Samsung Galaxy Domestic Industry Products”) sold in the United States. See generally Exhibit 9C (Declaration of Chang-Soo Pyon). SDC makes specialized OLED displays for each of the Samsung Galaxy Domestic Industry Products based on Samsung Electronics’ specific requirements for each such mobile phone product. Id., ¶¶ 4–6. These displays cannot be used without incorporation into the specific Galaxy S mobile device for which they were designed, and the Galaxy S mobile devices would lack their user interface without these customized displays. Id., ¶¶ 5–6. III. PROPOSED RESPONDENTS 15. The Proposed Respondents, upon information and belief, are importing, selling for importation, and/or selling after importation Accused Products, as described herein and as further described infra Sections IV, VI, and VII. A. MobileSentrix Entities 1. Apt-Ability LLC (d/b/a MobileSentrix) (“MobileSentrix”) 16.
