HUMAN RESOURCES POLICY MyTime Time Off Program Country: U.S. . Page: 1 of 3 PURPOSE The purpose of this policy is to describe the conditions under which eligible employees may take paid time off from work, known as PTO, for periods of uninterrupted rest and relaxation/vacation, to take care of personal business, or for sporadic illness. OUR PHILOSOPHY WIS International and its family of businesses, including without limitation Crossmark, Lawrence Merchandising Services, Product Connections, and RGIS, hires exceptional professionals to perform a wide variety of important functions that contribute to the success of our company. It is our intent to provide our dedicated employees the freedom they require to balance the responsibilities of both their work and home lives, thereby maximizing their value to WIS International. UNLIMITED PAID LEAVE It is the policy of WIS International to forego implementation of a leave accrual or bank system of any sort. Eligible employees will be free to take leave when they require it, a PTO program known as MyTime. Accordingly, the Company expects covered employees to determine for themselves, consistent with each employee’s responsibilities and business necessity, how much PTO to use and when to use it. Employees must exercise good judgment about using PTO. As such, they should anticipate important business activities, deliverables and deadlines when scheduling time off. At the Company’s discretion, leave may be tracked for business purposes. ELIGIBILITY The MyTime program covers full-time, exempt employees. These employees may begin using PTO on the 90th calendar day of employment. Effective January 1, 2022, this PTO policy supersedes and replaces all other paid time off, including without limitation personal, sick, or vacation, policies previously applicable to covered employees. NOTIFICATION AND USE MyTime may be used for any time off from work for vacation or other personal reasons. Covered employees must notify their manager of their request to take PTO for a foreseeable reason as far in advance as possible and generally no less than 14 days in advance, unless otherwise provided by applicable law. For Inventory employees, requests for PTO in December are to be submitted at least six (6) weeks before commencement. Exceptions must have the approval of the Vice President or department head. Understand that due to staffing needs, sometimes, not all leave requests can be approved. Advance requests are still subject to the appropriate approval. In order to ensure any legally protected leave is properly accounted for, employees should specify the reason PTO is sought (e.g., vacation, personal illness, to take care of a family member, military service). Page: 2 of 3 conflicts with operations, such as where a significant number of employees request the same period of vacation, or the workload is particularly heavy. A covered employee’s base salary remains the same during periods of PTO taken pursuant to this policy. Since employees do not accrue paid time off under this policy, employees will not be paid for any paid time off or vacation upon termination of employment unless required by applicable law. INTERACTION WITH OTHER FORMS OF LEAVE PTO taken for a qualifying reason under any applicable leave law, including without limitation the Family and Medical Leave Act (FMLA) or any sick or safe time law, will run concurrently with the leave required by law. The number of MyTime days that may be applied toward unpaid leave under the FMLA or the Americans with Disabilities Act is limited to 14 days. In no case will this MyTime policy increase the amount of leave, paid or unpaid, to which an employee is otherwise entitled by law. For more information on these types of leave, please see the corresponding company policy or contact Human Resources. PARAMETERS There is no minimum daily increment for using MyTime. Use may not exceed 14 consecutive calendar days at a time, unless required by special circumstances and approved by the department vice-president in advance or required by applicable law. Note - The mere fact an employee may be entitled to unpaid leave beyond 14 consecutive calendar days, at a time, is not an extenuating circumstance for continuation of MyTime. Covered employees remain eligible for other benefits and types of leave separate and distinct from this policy. As such, employees should continue to apply for any other monetary benefits and/or leave for which they may be eligible under the terms of other Company policy. EXPECTATIONS The Company expects managers to grant MyTime requests where possible, however managers retain discretion to deny or modify requests consistent with reasonable business needs. Employees should not be hesitant to take time off in the absence of allotted vacation days and there is no cap on the amount of approved PTO that an employee may take for proper reasons. However, except as provided otherwise by applicable law, each employee taking MyTime is still responsible for exercising professional judgment to ensure that inappropriately timed or excessive MyTime does not negatively affect the employee’s performance. Employees are responsible for meeting all established performance standards despite absences. Nothing in this policy shall relieve an employee of the obligation to perform their work satisfactorily. Except for those on protected leave (such as state or federal family and medical leave), if an eligible employee is unable to meet the expectations outlined above, WIS International reserves the right to temporarily revoke unlimited leave. Further, if gross abuse of this leave is observed, disciplinary action may be taken, which may include termination of employment. Page: 3 of 3 VERIFICATION Human Resources reserves the right to request verification of absences (such as a doctor’s note) when legal and appropriate to do so. Failure to abide by the requirements of this policy may lead to discipline, up to and including termination. The Company reserves the right to amend this policy.
