Tropicana Privilege Scan & Collect Points Campaign - Terms & Conditions TERMS AND CONDITIONS PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PARTICIPATING IN THE CAMPAIGN (as defined below) AS THEY CONTAIN BINDING LEGAL TERMS AND OBLIGATIONS INCLUDING LIMITATIONS OR EXCLUSION OF OUR LIABILITY. BY PARTICIPATING IN THIS CAMPAIGN, YOU ARE DEEMED TO HAVE FULLY READ, UNDERSTOOD AND AGREED TO THE TERMS AND CONDITIONS GOVERNING THIS CAMPAIGN. IF YOU DO NOT AGREE TO ANY OF THESE TERMS AND CONDITIONS, YOU MUST NOT PROCEED TO PARTICIPATE IN THE CAMPAIGN. 1. BASIC TERMS 1.1. Organiser: Tropicana Privilege (M) Sdn Bhd (Registration No. 202101043460 (1443760 - P) 1.2. Campaign: TROPICANA PRIVILEGE SCAN & COLLECT POINTS 1.3. Campaign Period: 1 st June 2023 to 31 st December 2023 2. ELIGIBILITY 2.1. Eligible Participants of the Campaign must be Malaysian Residents aged 18 and above at the time of entry into the Campaign (“ Eligible Participants ”), excluding : 2.2. The following categories of persons are NOT eligible to participate in the Campaign: - 2.2.1. Any person whose participation in / and association with the Campaign may cause (in the sole and absolute opinion of the Organiser and / or the Campaign any disrepute, contempt, scandal, ridicule, or cause the Or ganiser and the Campaign to be perceived unfavourably; 2.2.2. Any other person or class of persons deemed ineligible or notified by the Organiser as being ineligible from time to time; or 2.2.3. A person who is insane, bankrupt or subject to a criminal investigation or has criminal proceeding instituted against him or her in any jurisdiction, the Organiser reserves the sole and absolute discretion to determine the eligibility of any person in rela tion to the Campaign. 2.3. Eligible Participants may be required to submit further proof of their eligibility within such time frame as may be required by the Organiser, failing which, the Organiser shall be entitled to disqualify the Eligible Participants. 2.4. Disqualification 2.4.1. The Organiser reserves the right to disqualify the Purchasers, Eligible Participants or the Winner and/or revoke the Prizes (at any stage of the Campaign) if: - 2.4.1.1. Found ineligible or fails to meet any of the Eligibility Criteria; or 2.4.1.2. found to have submitted incomplete or inaccurate data ; or 2.4.1.3. There is a breach of the Terms and Conditions or other rules and regulations of the Campaign or violated any applicable laws or regulations by the Eligible Participants or the Winner; or 2.4.1.4. in the Organiser’s sole determination, it reasonably believes that there is fraud, cheating, or deception by the Eligible Participant or Winners. In the event of a disqualification after the Prize has been awarded, the Organiser reserves the right to demand for the return of the Prize or payment of its value from the said disqualified Winner. 2.6. For avoidance of doubt, the Organiser may at any time du ring the Campaign Period disqualify any person from participating in the Campaign without providing any reasons whatsoever. 2.7. The Organiser reserves the sole and absolute discretion to determine the eligibility of any person in relation to the Campaign. 2.8. The Organiser reserves the right to at any time, change, amend, delete or add to the Terms and Conditions and other rules and regulations in cluding the mechanism of the Campaign at its sole and absolute discretion. 3. Participating Outle t s are merchant outlets that have signed “ T Privi l ege L oyalty Program me Agreements ” with Tropicana Privi lege (M) Sdn Bhd The Organiser reserves the right to remove and/ or add a merchant outlet during the Campaign Period at its sole and absolute discretion. 3.2. The Organiser will hold a monthly lucky draw on the first Friday of the following month on T Privilege social media : 3.2.1. Instagram ( https://www.instagram.com/tprivilege_loyalty/ ) 3.2.2. There will be 1 lucky draw per month, with a total of six ( 6 ) lucky draws for the duration of the Campaign period. 3.3.1. Eligible Participants can have multiple entries to increase their chances of winning, as long as each entry is accompanied with a unique receipt/purchase at T Privilege’s participating outlets . However, having more lucky draw entries does not guarantee a win. The selection process is random. In the event of any dispute on the selection process, the Organiser’s decision shall be final, conclusive and binding. 3.5. Lucky draw entries and prizes are non - transferable and will expire once the Campaign Period ends as they are intended to only be part of the campaign. 3.6. The Eligible Participants must adhere to the brief mechanism of the Campaign set out above as may be briefed and communicated to the Eligible Participants by the Organiser from time to time. 3.7. The Campaign will be held during the Campaign Period set out in the Basic Terms. The Organiser reserves the right to vary, postpone, reschedule or extend the dates for the Campaign Period at its sole and absolute discretion. 3.8. The Organiser may terminate or suspend the Campaign at any time at its sole and absolute discr etion in which case, the Organiser may elect not to award any rewards or Prizes. Such termination or suspension will not give rise to any claim by the Eligible Participants. If the Organiser resumes the Campaign and carries on with the Campaign after such termination or suspension, the Eligible Participants shall abide by the Organiser’s decision regarding the resuming of the Campaign and disposition of the Prizes. If the Campaign period is revised, the number of gifts will be pro - rated according to the Campaign’s revised duration. 3.9. All entry instructions and any other specific details relating to the Campaign or the Prizes not specified herein shall form part of th ese Terms and Conditions. An EDM (Electronic Direct Mailer) and/or SMS (Short Message Service) as well as a call will be sent to Eligible Participants through information that the Eligible Participants have been submitted during the registration T Privilege Membership via the Tropicana 360 App 4.2. All Campaign communications will be available on T Privilege social media and within Tropciana 360 App 4.3. Eligible Participants and Winners agree and consent to be featured in any Organiser and/or Tropicana Group of Companies communication material for a period of (2) years on a complimentary basis. All copyrights subsisting in such communication material shal l belong to the Organiser and/or Tropicana Group of Companies. 4.4. The Eligible Participants and Winners agree and allow the Organiser and Tropicana Group of Companies to use the photos and comments for editorials, advertising, promotional, marketing and communication purposes 4.5. The Eligible Participants or Winner shall not without the prior written consent of the Organiser, publish or d isclose any information in connection with the Campaign or Prizes (Including without limitation, to any representatives of media in any form whatsoever). 4.6. Agrees that the Eligible Participant / Winner shall not give any product endorsement, any interviews or be involved in any articles or reports in respect of the Campaign or the Prize with any third party. 4.7. The Eligible Participants or Winner shall not by act or omission, directly or indirectly to bring the Organiser and/or Tropicana Group of Companies or its merchants (if any) and/or the Campaign into disrepute. 4.8. The Eligible Participants / Winners shall not dispute nor make any oral or written complaints, public announcements or statements on the same, whether during or after the Campaign Period. 4.9. Any decision made by the Organiser relating to this Campaign is final, conclusive and binding on all Eligible Participants and Winners. If any matter arises which is not covered in these Terms and Conditions, they will be determined solely by the Organiser and the Organiser’s decision is final, conclusive and binding. 4.10. The Organizer is also not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alteration or, use or member communications, or any problems or technical malfunction of the website, any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failu re of e - mail or players on account of technical problems or traffic congestion on the internet and/or website affected the progress of the Campaign. The Organiser is not responsible for any taxes, duties, fees, and/or all ancillary costs associated with the prize. The Winners are solely responsible for any such charges. 5.3. T he Organiser reserve s the right to substitute alternative prizes of equivalent or greater value with no notice without prior notice and/or liability. 5.4. All Prizes are strictly non - transferable, assignable, exchangeable or redeemable by the Winners in any other form or manner other than that specified by the Organiser. All specific or special terms and conditions that are attached to the Prizes must be adh ered to by the Winner s 5.5. The Winners acknowledge and agree that the prize provided does not come with any warranty or guarantee. 5.6. The prizes provided are offered "as is" without any express or implied warranties, including but not limited to fitness for a particular purpose, merchantability, or non - infringement. 5.7. The Organiser shall not be held responsible or liable for any defects, damages, or issues that may arise with the prize after it has been awarded. 5.8. The Winners of the Prizes assume all risks and r esponsibilities associated with the use, maintenance, or any consequences resulting from the use of the prize. 5.9. Any claims or concerns regarding the Prizes must be addressed directly with the manufacturer. The Organiser is not responsible for resolving an y such issues. 5.10. It is the Winners’ responsibility to claim their Prizes from the Organiser at Tropicana Gardens Property Gallery at Level G, Tropicana Gardens Mall, No.2A, Persiaran Surian , Tropicana Privilege Scan & Collect Points Campaign - Terms & Conditions Tropicana Indah, 47810 Petaling Jaya, Selangor, Malaysia 5.11. Failure to claim Prizes within sixty (60) days after first contact from Tropicana Privilege’s team, shall result in the Prizes being forfeited and t he Organiser reserves the right not to entertain any claim received outside the aforementioned Claim Period. 5.12. If the Winner chooses not to accept a Prize, the Prize shall be forfeited and the Prize will be dealt with according to the sole and absolute discretion of the Organiser. 5.13. The Organizer’s decisions are final, conclusive and binding and no correspondence ther eon will be entertained. All Eligible Participants shall not resort to court proceedings to review the Organiser’s decisions. 6. W ARRANTIES 6.1. The Eligible Participant represents and warrants with the Organiser that – 6.1.1. The Eligible Participant has met all the eligibility criteria and has the right, authority and power to enter into the Campaign in accordance with Terms and Conditions and shall provide such proof as the Organiser requires; 6.1.2. All the statements (if any and if so required) made by the Eligible Participants to the Organiser are true, correct, accurate and complete. 6.2. In consideration of the Organiser offering to the Eligible Participant the opportunity to participate in a Campaign , the Eligible Participant hereby unconditionally and irrevocably: - 6.2.1. Agrees that if so, required by the Organiser, to make himself/herself available (without compensation) for the production, recording and publicity of the Campaign during such time, and pr oduction schedule as may be notified by the Organiser: - (i) Interview (which shall be recorded); and/or (ii)Taking of still photos, audio and/or visual recording for promotions and publicity use. (Collectively “Recording”). 6.2.2. Agrees and consents that the Or ganiser shall have right and absolute discretion to broadcast the Recording and/or use the slogan, names or nicknames on any of its programmes/channels in whole or in part at the Organiser’s discretion. All copyrights subsisting in the Recording shall belo ng to the Organiser absolutely. 6.2.3. Confirms that the Eligible Participant has read, understood and agreed to the Terms and Conditions of the Campaign and shall abide by the said Terms and Conditions accordingly, including to cooperate and follow all instructi ons given to the Eligible Participant. 6.2.4. Agrees that all Prizes to be awarded in the Campaign is contingent upon the accuracy of the information provided and disclosures made by the Eligible Participant / Winner and partner accompanying the Eligible Particip ant / Winner and the full and complete performance of the Eligible Participant and partner accompanying the Eligible Participant / Winner warranties, undertakings and obligations hereunder. 6.2.5. Agrees that the Eligible Participant / Winner shall not by act or make omission, directly or indirectly to bring the Organiser and/or Tropicana Group of Companies into disrepute. 6.2.6. PROMOTIONAL ACTIVITIES 7.1. The Organiser reserves the right to send SMS messages or email notification to the Eligible Participants or Winners’ mobile phone number or email address containing information and promotional activities regarding any other Tropicana Group of Companies promotions. 7.2. If an Eligible Participant does not wish to receive such SMS messages or email notifications, the Eligible Participant or Winner is required to inform the Organiser accordingly. 8. GOVERNING LAW 8.1. This Terms and Conditions shall be construed, governed and interpreted in accordance with the laws of Malaysia. 9. INDEMNITY 9.1. The Eligible Participant forever waives, releases and discharges the Organiser of any and all liabilities, costs, loss, damages or expenses which the Eligible Participant or any party claiming through the Eligible Participant hereafter may have, arising out of acceptance of any Prizes or participation in the Campaign, including but not limited to personal injury or damage to property and whether or not direct, consequential or foreseeable. 9.2. The Eligible Participant shall indemnify the Organiser, its affiliates, agent and sponsors from and against all liability, costs, loss or expense s suffered thereby as a result of the Eligible Participant’s breach of the eligibility criteria, Eligible Participant’s warranties and undertakings and any breach of the Terms and Conditions and/or the rules and regulations of the Campaign. 10. PERSONAL DATA PROCESSING STATEMENT RELATING TO ELIGIBLE PARTICIPANTS (“NOTICE”) IN ACCORDANCE WITH PERSONAL DATA PROTECTION ACT, 2010 (“PDPA”) AND PUBLICITY 10.1. The PDPA governs the processing of the Eligible Participant’s personal data (“ Personal Data ”) by the Organiser. This Notice is issued to Eligible Participants to inform that this is the basis upon which the processing of the personal data is done by the Organiser. 10.2. Purpose: All information (including personal data) submitted by Eligible Participants in th eir participation of the Campaign shall belong to the Organiser and the Eligible Participants irrevocably and unconditionally consent and permit the Organiser to use, publish or feature the Eligible Participants’ and/or their photos (which may include the Eligible Participant’s name, statements about the Campaign or any of its related matter) without further notice or compensation for publicity, advertising or any other related purposes in any manner whatsoever, including but not limited to in any of the Or ganiser’s publications, websites and/or any promotional materials connected to the Campaign. This includes disclosing the Eligible Participants’ name or photos to the general public when the Eligible Participants become a winner of the Prizes. 10.3. The Organis er may also use the Eligible Participants’ personal information for purposes of Clause 7 Tropicana Privilege Scan & Collect Points Campaign - Terms & Conditions 10.4. Transfer: The Eligible Participants’ personal data will be kept confidential by the Organiser but the Eligible Participants agree that for the purposes set out in Clause A10(2) above, the Organiser may transfer or disclose such personal data to the following parties within or outside of Malaysia: 10.4.1. The Organiser’s agents or contractors under a duty of confidentiality to the Organiser providing administrative, telecommunications, data processing or other services to the Organiser in relation to the Campaign (such as but not limited to professional advisers, customer call centre providers, gift redempt ion centres or data entry companies); 10.4.2. Any affiliates that owe a duty of care to the Organiser; 10.4.3. Any law enforcement agency and/or regulatory body for compliance with applicable laws, rules, regulations, codes and/or guidelines and/or any person or entity to whom the Organiser is under a binding obligation to make disclosure under the requirements of any law, rule, regulations, code and/or guideline and/or order of any competent court of law, law enforcement agencies and/or regulatory bodies. 10.5. Access: The Eligible Participants have the right to request access to and to request correction of the relevan t personal data. Nothing herein contained shall limit the rights of any Eligible Participant under the PDPA. - END -
