HISENSE LUFC MAY 7th 2021 SOCIAL PRIZE DRAW TERMS AND CONDITIONS 1. The Promoters The promoter is: Hisense UK Limited of Unit 2 Meadow Court, Millshaw, Leeds, England, LS11 8LZ (the "Promoter"). The Promoter is running this prize draw in collaboration with Leeds United Football Club Limited of Elland Road Stadium, Elland Road, Leeds, LS11 0ES ("LUFC"). 2. The prize draw 2.1. The title of the prize draw is: "Hisense LUFC May 7th 2021 Social Prize Draw". 2.2. During the Prize Draw Period (detailed below) the Promoter and LUFC will each be publishing a promotional post via their respective Instagram, Facebook and Twitter accounts (the "Promotional Post"). 2.3. In order to enter the prize draw, entrants will need to follow the steps outlined at section 3.3 below and will then be entered into a prize draw gaining the chance to win a Prize. Two winners will be selected to win a Prize. 3. How to enter 3.1. The prize draw will run from 17.30 on 7th May 2021 (the "Opening Date") to 23.59 on 13th May 2021 (the "Closing Date") inclusive (the "Prize Draw Period"). 3.2. You must have access to the Internet and an Instagram, Facebook or Twitter account to participate in the prize draw. 3.3. To enter the prize draw you must, during the Prize Draw Period: 3.3.1. 'Like' or 'follow' both Hisense UK and LUFC on either Facebook, Instagram or Twitter; 3.3.2. ‘Like’ the promotional post on either Facebook, Instagram or Twitter; 3.3.3. Comment your player of the season. 3.4. You will then be entered into a prize draw gaining the chance to win a Prize. 3.5. No purchase is necessary to enter the prize draw. 3.6. By entering the prize draw, you are agreeing to be bound by these terms and conditions. 4. Eligibility 4.1. The prize draw is only open to residents in the UK aged 18 years or over, except: (i) employees of the Promoter, LUFC or either of their respective holding or subsidiary companies; (ii) employees of agents or suppliers of the Promoter or LUFC or their respective holding or subsidiary companies, who are professionally connected with the prize draw or its administration; or (iii) members of the immediate families or households of (i) and (ii) above. 4.2. In entering the prize draw, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the prize draw, such as proof of identity and age. 4.3. The Promoter will not accept prize draw entries that are: (i) automatically generated by computer; (ii) completed by third parties or in bulk; or (iii) incomplete. 4.4. Entries must not feature content which (i) the Promoter (in its absolute discretion) considers to be offensive or otherwise objectionable (ii) is unlawful or infringes third party copyright or intellectual property rights or (iii) promotes excessive drinking, anti-social behaviour or potentially dangerous behaviour. 4.5. There is a limit of one entry per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed. 4.6. The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize draw. 4.7. The Promoter will not accept responsibility for prize draw entries that are lost or delayed in transit or incorrectly posted or for failures to post entries, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind. 4.8. The Promoter will not accept entries which fail to meet the requirements under section 3.3 above. 5. The Prize 5.1. Two winners will be selected to win a prize. Each will win 1x signed Leeds United shirt and 1x signed ball (the "Prize"). 5.2. The Prize includes delivery within the UK, but any other costs incurred in addition to delivery within the UK that are incidental to the fulfilment of the Prize are the responsibility of the winner. 5.3. The Prize is subject to availability. 5.4. There is no cash alternative for the Prize. 5.5. The Promoter reserves the right to substitute the Prize or any part of the Prize with an item or items of equal or greater value. 5.6. The Prize is not negotiable or transferable. 6. Selecting and Announcing Winner 6.1. Entrants who follow the steps listed at section 3.2 above, will be entered into a prize draw for the Prize. The winners will then be chosen by random draw performed by a computer process. The draw will be carried out within seventy-two (72) hours of the Closing Date and the winners will be announced as soon as possible thereafter (the "Announcement Date"). 6.2. The winners will be contacted as soon as practicable after the prize draw is carried out using Facebook or Instagram or Twitter messaging. The Promoter will make all reasonable efforts to contact the winners. If a winner cannot be contacted or is not available, or has not claimed their Prize and provided all information reasonably required by the Promoter within five (5) days of first being contacted by the Promoter, the Promoter reserves the right to select an alternative winner, in accordance with the process outlined above. 6.3. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter may publish the surname and county of the Prize winner on its promotional Facebook/ Instagram / Twitter pages, and/ or will send the surname and county of the Prize winner to anyone who contacts the address set out in 11.4 within one (1) month after the Closing Date of the prize draw. 6.4. If you object to any or all of your surname and county being published or made available, please contact the Promoter. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request. 7. Delivery of the Prize 7.1. Please allow fourteen (14) days following the Closing Date for delivery of the Prize. 7.2. The Promoter does not accept any responsibility if you are not able to take up the Prize or to accept delivery of it. 8. Ownership of and Rights to Use Prize Draw Entries 8.1. Except as detailed in paragraph 8.2 below, the Promoter does not claim any rights of ownership in your prize draw entry. Accordingly, you will retain ownership of all copyright and other intellectual property rights (if any) in your prize draw entry. However, by participating in the prize draw you agree that the Promoter and/ or LUFC may use your prize draw entry to promote the prize draw and their products more generally, as detailed in paragraph 8.2 below. 8.2. By participating in the prize draw, you agree that the Promoter and/ or LUFC may, but are not required to, use and make your entry available, on their websites and via their social media channels and in any other media, whether now known or invented in the future, to publicise the prize draw and/ or in connection with the promotion of the Promoter's or LUFC's products and businesses more generally. You agree to grant each of the Promoter and LUFC a non-exclusive, worldwide, royalty-free, irrevocable licence, for the full period of any intellectual property rights in your prize draw entry, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the prize draw entry for such purposes. 9. Limitation of liability 9.1. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected. 10. Data Protection and Publicity 10.1. If you are selected as a winner, you will be asked to provide the Promoter with personal data including your full name and contact details as well as a UK delivery address for the Prize. Proof of ID may also be requested. Your prize draw entry may also include personal data, for example, the images of you or other people featured in the photograph you have created. If other people appear in your prize draw entry you must make sure that they have consented to appear in your photograph and that they have agreed that the prize draw entry may be used in accordance with these terms and conditions. 10.2. The Promoter will use and process your personal information for the purposes of operating and administering the prize draw as detailed in these terms and conditions, including (if you are selected as a winner) for the purposes of announcing the winner and arranging delivery of the Prize. 10.3. The Promoter may share the personal data with its agents, suppliers and any other third parties involved in running the prize draw, including LUFC, the Promoter's marketing agency (Ponderosa) as well as the Promoter's delivery company. However, the Promoter will take steps to ensure that such third parties only use the personal data for the purposes described in this section. Your prize draw entry may also be published and made available to the public for the purposes described in section 8.2. 10.4. Disclaimers 11.1. This promotion and prize draw is in no way sponsored, endorsed or administered by, or associated with Facebook, Instagram or Twitter. You are providing your information to the Promoter and not to Facebook, Instagram or Twitter. 11.2. You agree that Facebook, Instagram and Twitter shall have no liability in respect of this promotion or prize draw. 11.3. Any comment or photo you post on Facebook, Instagram or Twitter must comply with all applicable terms and conditions stipulated by Facebook, Instagram or Twitter concerning content which is posted or shared on their platforms. 12. General 12.1. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the prize draw. 12.2. The Promoter reserves the right to hold void, suspend, cancel, or amend the prize draw, or to amend these terms and conditions, where (in the reasonable discretion of the Promoter) it considers it necessary to do so. 12.3. These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales. 12.4.
