It took longer for the Crown to confirm its availability for a case conference than anticipated. Nonetheless, I can confirm that the parties have now agreed to dates for a case conference. Our case conference brief outlining the issue for the conference (namely, to schedule the hearing promptly) is attached here and has been filed with the Court. Provided the Court has availability for us, the Case Conference will occur on either May 2, 4, 5, or 19 th We have very compelling grounds for the Court to agree to schedule a hearing now that the costs are paid, the Crown has not served or scheduled the motion for security for costs (for months), and the criminal crown counsel agreed to allow this application to proceed on a waiver of an 11(b) defence and undertook not to pursue the charges if this application is successful. I am aiming to have our updated Application Record served and filed by the time the case conference is heard in May, meaning we will have to start contacting our experts to get them to sign “fresh” evidence (even if it is a carbon copy of a report they filed previously, the expert will still have to swear to a freshly updated affidavit).
