TERMS AND CONDITIONS The Owner hires the costume to the Hirer on the following terms and conditions:- 1. The period of hire starts and finishes on the time and date specified. 2. The Hirer agrees and acknowledges:- a. That they have inspected the costume and are satisfied that it is of suitable quality and fit for the purpose for which it is hired; b. The costume is not subject to any warranties of any kind except as are expressed herein or are included or implied by law c. They will pay the bond and hire fee specified upon signing this agreement; d. During the period of hire they are responsible to the Owner for any loss or damage to the costume for any reason whatsoever; e. They will not modify or alter the costume in any way without the prior written approval of the Owner; f. They will not part with possession of the costume; g. The costume will be returned to the Owner by the end of the period of hire, in the same condition and state of repair as at the start of the hire period, subject only to fair wear and tear. h. The Owner may deduct from the bond, the cost of replacement, repair or cleaning the costume and of any loss or damage occurring during the period of hire and the Hirer shall pay to the Owner any additional amount which exceeds the bond after the Hirer receives an invoice for the cost of replacement and/or repair. 3. The Owner may terminate this agreement at any time by written notice to the Hirer and may repossess the costume if the Hirer breaches this agreement or if the Hirer commits any act of bankruptcy or being a company enters into any scheme of arrangement with creditors. 4. If this agreement is terminated by the Owner for any reason without prejudice to any other rights of the Owner, the Hirer shall forthwith return the costume to the Owner and pay all moneys due to the Owner pursuant to this agreement. 5. In the event that the Hirer fails to return the costume to the Owner by the time specified, the Hirer will be liable to the Owner for additional hire fees at the rate specified in the Agreement and the Owner shall be entitled (without prejudice to any other rights or entitlements) to deduct from the bond held any amounts due up to and until the costume is returned to the Hirer or repossessed by the Hirer. No indulgence granted by the Owner shall affect the Owner’s rights under this agreement. 6. Any notice required under this agreement shall be validly served if it is posted by pre-paid ordinary mail to the Hirer at the address of the Hirer in this agreement. 7. The Hirer is responsible for all duties and statutory charges which may arise as a result of this agreement. 8. A replacement fee will be charged for any Wardrobe bags not returned by the return date specified on the hire agreement.
