______________________________________________________________________________________________________________________________________ Code of Conduct Act 2019 of the Habboon Defense Agency ______________________________________________________________________________________________________________________________________ (ii) cause or induce any person to— (1) withhold testimony, or withhold a record, document, or other object, from an official proceeding; (2) alter, destroy, mutilate, or conceal evidence with intent to impair the integrity or availability of the evidence for use in an official proceeding; (3) evade legal process summoning that person to appear as a witness, or to produce a record, document, or other object, in an official proceeding; or (4) be absent from an official proceeding to which that person has been summoned by legal process; or (iii) prevent the communication by any person to a judge of the Agency of information relating to the commission or possible commission of an offense; shall be punished as provided in paragraph (3). (c) The punishment for an offense under this subsection is— (i) in the case of a potential felony charge or supporting testimony to a felony charge, they shall be fined under this title or terminated, or both. (ii) in any other case, they shall be fined under this title or suspended, or both. SEC. 207. PERJURY Whoever— (a) having taken an oath before a competent court, officer, or person, in any case in which a law of the Agency authorizes an oath to be administered, that he will testify, declare, depose, or certify truly, or that any written testimony, declaration, deposition, or certificate by him subscribed, is true, willfully and contrary to such oath states or subscribes any material matter which he does not believe to be true; or (b) in any declaration, certificate, verification, or statement under penalty of perjury willfully subscribes as true any material matter which he does not believe to be true; is guilty of perjury and shall, except as otherwise expressly provided by law, be fined under this title or suspended, or both. (c) procures another to commit any perjury is guilty of subornation of perjury, and shall be fined under this title or demoted, or both. (d) under oath (or in any declaration, certificate, verification, or statement under penalty of perjury) in any proceeding before or ancillary to any court of the Agency knowingly makes any false material declaration or makes or uses any other information, including any document, record, recording, or other material, knowing the same to contain any false material declaration, shall be fined under this title or suspended, or both. ______________________________________________________________________________________________________________________________________ Code of Conduct Act 2019 of the Habboon Defense Agency ______________________________________________________________________________________________________________________________________ SEC. 208. AVOIDING PROSECUTION (a) Whoever makes oneself unavailable or unreachable to Employees of the Agency or Officers of the Court with intent either (1) to avoid prosecution for a crime, or an attempt to commit a crime, or (2) to avoid giving testimony in any criminal proceedings, or (3) to avoid service of, (b) or contempt proceedings for alleged disobedience of lawful process requiring attendance, shall be fined under this title or terminated, or both. TITLE III - FRAUD, DISHONESTY AND CONFLICTS OF INTEREST SEC. 301. CONSPIRACY TO COMMIT OFFENSE OR TO DEFRAUD THE AGENCY (a) If two or more persons conspire either to commit any offense against the Agency, or to defraud the Agency, in any manner or for any purpose, and one or more of such persons do any act to effect the object of the conspiracy, each shall be fined under this title or terminated, or both. (b) If, however, the offense, the commission of which is the object of the conspiracy, is a misdemeanor only, the punishment for such conspiracy shall not exceed the maximum punishment provided for such misdemeanor. SEC. 302. FALSE PERSONATION (a) Whoever falsely assumes or pretends to be an employee acting under the authority of the Agency or any Unit thereof, and acts as such, or in such pretended character demands or obtains any money, document, or thing of value, shall be fined under this title or suspended, or both. (b) Whoever falsely represents himself to be an officer of a court of the Agency, and in such assumed character charges any person, shall be fined under this title or demoted, or both. (c) Whoever, with intent to defraud within the Agency, falsely assumes or pretends to be an agent of alien establishment duly accredited as such to the Agency and acts as such, or in such pretended character, demands or obtains or attempts to obtain any money, document, or other thing of value, shall be fined under this title or banned, or both. (d) Whoever, knowingly and with intent to defraud the Agency, or any Unit thereof, possesses any false, altered, forged, or counterfeited writing or document for the purpose of enabling another to obtain from the Agency, or from any Unit, or officer thereof, any document, sum of credits, or thing of value, shall be fined under this title or suspended, or both. SEC. 303. BRIBERY (a) Whoever— (i) directly or indirectly, corruptly gives, offers or promises anything of value to any person who has been selected to appear in an official proceeding, or offers or ______________________________________________________________________________________________________________________________________ Code of Conduct Act 2019 of the Habboon Defense Agency ______________________________________________________________________________________________________________________________________ promises any person who has been selected to appear in an official proceeding to give anything of value to any other person or entity, with intent— (1) to influence any official act; or (2) to influence such person who has been selected to appear in an official proceeding to commit or aid in committing, or collude in, or allow, any fraud, or make opportunity for the commission of any fraud, on the Agency; (3) to induce such person who has been selected to appear in an official proceeding to do or omit to do any act in violation of the lawful duty of such official or person; shall be fined under this title or terminated, or both. (ii) being a person who has been selected to appear in an official proceeding directly or indirectly, corruptly demands, seeks, receives, accepts, or agrees to receive or accept anything of value personally or for any other person or entity, in return for: (1) being influenced in the performance of any official act; (2) being influenced to commit or aid in committing, or to collude in, or allow, any fraud, or make opportunity for the commission of any fraud, on the Agency; or (3) being induced to do or omit to do any act in violation of the official duty of such official or person; shall be fined under this title or terminated, or both. SEC. 304. EXTORTION (a) Whoever, being an employee of the Agency, under color or pretense of office or employment commits or attempts an act of extortion, shall be fined under this title or suspended, or both. (b) Whoever, under threat of informing, or as a consideration for not informing, against any violation of any law of the Agency, demands or receives any credits or other valuable thing, shall be fined under this title or demoted, or both. SEC. 305. RECUSAL (a) Any judge of the Agency shall disqualify oneself in any proceeding in which one’s impartiality might reasonably be questioned. (b) One shall also disqualify oneself in the following circumstances: (i) Where one has a personal bias or prejudice concerning a party, or personal knowledge of disputed evidentiary facts concerning the proceeding; (ii) Where one served as lawyer in the matter in controversy; ______________________________________________________________________________________________________________________________________ Code of Conduct Act 2019 of the Habboon Defense Agency ______________________________________________________________________________________________________________________________________ (iii) Where he has participated as counsel, adviser or witness in the proceeding or expressed an opinion concerning the merits of the particular case in controversy; (c) “proceeding” includes pretrial, trial, appellate review, or other stages of litigation. TITLE IV - OFFENSES AGAINST THE PERSON, PROPERTY AND THE PEACE SEC. 401. TRANSPORTING OR DISTRIBUTING OBSCENE OR CRIME INCITING MATTER (a) Whoever knowingly produces with the intent to transport, distribute, or transmit for the purpose of sale or distribution of any obscene, lewd, lascivious, or filthy picture, film,writing, drawing, figure, image, or other article capable of producing sound or any other matter of indecent or immoral character, shall be fined under this title or terminated, or both. (b) The distribution as aforesaid of two or more copies of any publication or two or more of any article of the character described above, or a combined total of five such publications and articles, shall create a presumption that such publications or articles are intended for sale or distribution, but such presumption shall be rebuttable. (c) Whoever is engaged in the business of producing with intent to distribute or sell, or selling or transferring obscene matter, who knowingly receives or possesses with intent to distribute any obscene picture, film, or audio recording, which has been distributed, shall be punished by suspension by a fine under this title, or both. (d) Whoever, knowingly transfers obscene matter to another individual who has not attained the age of 16 years, knowing that such other individual has not attained the age of 16 years, or attempts to do so, shall be fined under this title, terminated, or both. SEC. 402. SEXUAL ABUSE Whoever knowingly, (a) causes another person to engage in a sexual act by threatening or placing that other person in fear; or (b) engages in a sexual act with another person if that other person is— (i) incapable of appraising the nature of the conduct; or (ii) physically incapable of declining participation in, or communicating unwillingness to engage in, that sexual act; or attempts to do so, shall be fined under this title and terminated, or both. (c) engages in a sexual act with another person who— (i) has attained the age of 12 years but has not attained the age of 16 years; and ______________________________________________________________________________________________________________________________________ Code of Conduct Act 2019 of the Habboon Defense Agency ______________________________________________________________________________________________________________________________________ (ii) is at least four years younger than the person so engaging; (iii) or attempts to do so, shall be fined under this title, terminated, or both. SEC. 403. ASSAULT (a) In General.— verbally assaults, resists, opposes, impedes, intimidates, or interferes with any person while engaged in or on account of the performance of official duties; or shall, where the acts in violation of this section constitute only simple verbal assault, be fined under this title or demoted, or both, and where such acts involve intimidation, resistance, or hindering, be fined under this title or suspended, or both. (b) verbally assaults, intimidates, resists, opposes, impedes, or interferes with the lawful orders of any Employee of the Agency, shall, where the acts in violation of this section constitute only simple verbal assault, be fined under this title or striked, or both, and where such acts involve intimidation, resistance, or hindering, be fined under this title or demoted, or both. SEC. 404. CONSPIRACY AGAINST RIGHTS (a) Whoever conspires to oppress, threaten, or intimidate any person in the free exercise or enjoyment of any right or privilege secured to him by the laws of the Agency, or because of his having so exercised the same; They shall be fined under this title or suspended or both; and if disregard of lawful orders is involved they shall be fined under this title or terminated or both. SEC. 405. HATE CRIME ACTS (a) In General.— (i) Offenses involving actual or perceived race, color, religion, national origin, sexual orientation, belief, creed or other distinctive, or protected characteristic.— Whoever, whether or not acting under color of law, willfully abuses or attempts to abuse to any person, because of the actual or perceived race, color, religion, national origin, sexual orientation, belief, creed or other distinctive, or protected characteristic — (1) shall be suspended, fined in accordance with this title, or both; and (2) shall be terminated, fined in accordance with this title, or both, if — a) administrative action result from the offense. (b) Whoever directly or indirectly deprives, attempts to deprive, or threatens to deprive any person of any employment, position, or other benefit provided for or made possible in whole or in part by any Law of the Agency, on account of political affiliation, race, color, religion, ______________________________________________________________________________________________________________________________________ Code of Conduct Act 2019 of the Habboon Defense Agency ______________________________________________________________________________________________________________________________________ national origin, sexual orientation, belief, creed or other distinctive, or protected characteristics, shall be fined under this title, or terminated, or both. SEC. 406. WRONGFUL ADMINISTRATIVE ACTION (a) Whoever attempts or succeeds in wrongfully imposing an administrative action on another Employee shall be fined under this title and; (i) suspended if the offense is committed knowingly; or (ii) demoted if the offense is committed unintentionally yet involves disregard of orders; or (iii) striked if the offense is committed unintentionally. (b) Paragraph (a) of this section shall not apply to promotions if those are given on an ex post facto basis and are substantiated. SEC. 407. MALFEASANCE (a) Whoever abuses one’s statutory or nonstatutory powers, including Room Rights, to commission an unlawful or lawful act, done in an official capacity, with the intent of affecting or affecting; (i) official duties; or (ii) rewards; or (iii) performance; or (iv) another individual’s status; (v) another Employee’s rank or position. shall be fined under this title, or terminated, or both. (b) Whoever abuses one’s Room Rights within a HDA affiliated room for the commision of an unlawful or lawful act, done in an official capacity shall be fined under this title, or suspended, or both. SEC. 408. DISTURBANCE OF THE PEACE (a) Whoever uses any enable, other than “:enable 0” to disable an effect enabled by default or manually, shall be fined and striked under this title or both. (b) Whoever uses colored chat bubbles within HDA affiliated rooms shall be fined and striked under this title or both, unless; (i) one is an Employee holding an iC Position wishes to make an announcement, in which case one may use green colored chat bubbles; (ii) one is an Employee and one makes an emergency announcement driven by a force majeure, in which case one may use red coloured chat bubbles; (iii) one is second in command or higher, and one informs Employees of an important event of the Agency, in which Employees situated within the room in which such ______________________________________________________________________________________________________________________________________ Code of Conduct Act 2019 of the Habboon Defense Agency ______________________________________________________________________________________________________________________________________ notice is given are to attend at that event, in which case one may use light blue chat bubbles; (iv) one trains recruited person(s), in which case one may use coloured chat bubbles (v) one hosts a Mentoring Session for Employees, in which case the colour and styling of the chat bubbles lies at the discretion of the host; (vi) one presides over, or is recognised by the presiding officer of a legislative or judicial proceeding as an authorised Employee to utilise colored chat bubbles, in which case the color and styling of the chat bubbles lies at the nature of such event, and may not be constricted through Statute; (vii) one is to deliver a speech, within a formal event of the Agency, in which case the color and styling of the chat bubbles lies at the nature of such event, and may not be constricted through Statutes; (1) “Formal Event of the Agency” shall refer to all events or happenings that have been approved by the Executive Leadership and pertain to the Agency. (c) Whoever uses supermajority uppercase letters within a room affiliated to the Agency shall be fined or warned under this title, or both. (i) supermajority uppercase phrases shall be considered chat bubbles, in which two-thirds of the message are uppercase characters; (ii) Acronyms, exclamations and abbreviations are excluded from paragraph (i) of this subsection. SEC. 409. RENUNCIATION (a) Whoever willfully and with full knowledge of one’s actions fully or temporarily disinvests in one’s employment to the Agency or status therein with the intent of; (i) concealing place, type of standing of employment in the Agency; or (ii) maliciously conspiring against the Agency; or (iii) seeking another place of employment or attainment of a status shall be fined or terminated, or both under this title. (b) Whoever, out no volition but one’s own, does not appear online in the boon client for three consecutive days, and has failed to log a Leave of Absence informing the Executive Leadership of one’s absence shall be fined under this title or suspended, or both. (c) Whoever, out no volition but one’s own, does appear online in the boon client however fails to fill any workstation within the Agency’s affiliated rooms, or fails to complete one’s legally mandated tasks or responsibilities, or both, shall be fined under this title or demoted, or both. SEC. 410. BREACH OF DUTY ______________________________________________________________________________________________________________________________________ Code of Conduct Act 2019 of the Habboon Defense Agency ______________________________________________________________________________________________________________________________________ (a) Whoever willfully, through ignorance, malice or oversight fails or neglects or omits the commission of a task which they are legally required to perform, not to perform, or prevent from performing. If such neglect or omission is such as to endanger or threaten the public welfare, it is gross. (b) Whoever is found being away-from-keyboard or unresponsive or both, while manning a workstation they shall be fined under this title, or warned, or both. ATTEST
