not yet availableDie Arbeit befasst sich mit Abweichungen vom Deutschen Corporate Governance Kodex und von § 161 AktG als Pflichtverletzung im Sinne der Untreue und soll insbesondere zur Klärung der Rechtsnatur dieses aktiengesellschaftsrechtlichen Regulierungsinstruments, welches in unserer Rechtsordnung seinesgleichen sucht, beitragen. Aus strafrechtlicher Perspektive ganz in den Mittelpunkt gerückt wird hierbei das Pflichtverletzungsmerkmal des § 266 StGB im Kontext der Organuntreue, welche Rechtsprechung und Wissenschaft zunehmend beschäftigt. Vertieft nachgegangen wird dabei der Frage, inwieweit der Untreuetatbestand zivilrechtsakzessorisch ist. Außerdem wird untersucht, ob jeder Verstoß gegen die aus §§ 93 Abs. 1 S. 1, 116 S. 1 AktG folgende Legalitätspflicht der Organmitglieder von Aktiengesellschaften auch eine Pflichtverletzung im Sinne der Untreue darstellt.

The early days of tourism development had a naïve vision of tourism’s impacts on society in terms of economic, social, and environmental benefits. Time has passed, and we have learnt lessons regarding the success and failure of tourism development. Mass tourism development has pros and cons and is not necessarily the optimal development model. Alternative development strategies should be contemplated. This Special Issue deals with different topics concerning optimal tourism development. Destination management requires further understanding of different issues, such as carrying capacity, income-based optimal supply size, identification and development of optimal market niches, and adaptation or environmental protection strategies. Tourism planning is concerned with the role of economies of agglomeration, i.e., the advantages of spatial clusters vs scattered development. Additionally, support for and investment in innovation, accessibility, and mobility are relevant nowadays. From the stakeholders’ perspective, it is relevant to discuss ways of cooperating and sources of conflicts among different sectors and actors, governance and incentives for sustainable tourism practices, and equity and economic distribution of benefits. Finally, the development of methodological tools for the assessment of optimal tourism development is necessary for policy making, in particular the development of methods that are capable of integrating economic, environmental, and social criteria.

Who is a child’s legal mother? Must a child have exactly one mother, can it have two or three, or can it have two fathers, but no mother? Or has the concept of motherhood become obsolete and should we just talk of parenthood in a gender neutral way? Questions such as these would have appeared esoteric only a few decades ago, but as a result of new social developments (such as frequent family reconstitutions, gay and lesbian emancipation or surrogacy) and of technological innovations (such as egg and embryo donations) they have become issues in a vehement debate. The interdisciplinary contributions to this book focus on the legal definition of motherhood, on the way in which legal conceptions structure the social discourse on motherhood (and vice versa), and on the influence of legal rules on power relations between mothers, fathers, children and the state. Among the issues addressed are - the challenges to our understanding of the legal regulation of motherhood by developments in reproductive medicine; - the challenges to our understanding of the legal regulation of motherhood by parental constellations deviating from the mother-father-model (single motherhood by choice, same-gender parenthood, multiple parenthood); - the exercise of parental rights in case of parental separation and the impact of legal rules on the bargaining positions of mothers and fathers.

During the past decades, the subject of calculus of integrals and derivatives of any arbitrary real or complex order has gained considerable popularity and impact. This is mainly due to its demonstrated applications in numerous seemingly diverse and widespread fields of science and engineering. In connection with this, great importance is attached to the publication of results that focus on recent and novel developments in the theory of any types of differential and fractional differential equation and inclusions, especially covering analytical and numerical research for such kinds of equations. This book is a compilation of articles from a Special Issue of Mathematics devoted to the topic of “Recent Investigations of Differential and Fractional Equations and Inclusions”. It contains some theoretical works and approximate methods in fractional differential equations and inclusions as well as fuzzy integrodifferential equations. <P>The purpose of th is study is to describe certain features of Tsvetaeva's intermediate world and to demonstrate its relation to several peculiarities of Tsvetaeva's poetics, specifically, her predilection for oxymoron and the ambiguous nature and behavior of her lyrical personae. Furthermore, these important structural elements are viewed as inherent in Tsvetaeva's dichotomous poetic vision. Two thematic cores, "love" and "poetry", are analyzed with particular attention given to the investigation of the nature of their opposition. An analysis of the "love"/"poetry" pair specifically serves as a vehicle for obtaining information about the intermediate world. </P>
