Formal Complaint – Infringement of EU Registered Design No. 015117871-0002 (Headbands) Request for Immediate Removal and Enforcement Action Dear Amazon Legal Department, I am writing as the lawful proprietor of the European Union Registered Design (EUD) No. 015117871-0002, titled Headbands, which was registered and granted by the European Union Intellectual Property Office (EUIPO) on 25 September 2025. I, Zhang Guangyong, am the exclusive owner of all rights in this registered design. 1. Details of the Infringement It has come to my attention that the Amazon France (Amazon.fr) seller listed below is offering and marketing a product that infringes my EU registered design: Seller name: Telinei Seller ID: A33KUGQRFA9OJK Infringing ASIN: B0FDJFLTSV Infringing link: https://www.amazon.fr/dp/B0FDJFLTSV The above-mentioned product unlawfully reproduces and exploits the protected appearance of my EU- registered design without any authorization, licence, or consent. European Union Law – Community Design Regulation The seller’s conduct constitutes infringement under Council Regulation (EC) No. 6/2002 on Community Designs, including but not limited to: Article 19(1) – The exclusive right of the registered design holder to use the design and to prevent any unauthorized third-party use Article 10 – Scope of protection covering any design that does not produce a different overall impression on the informed user Article 89 – Enforcement measures and remedies in cases of infringement B. French National Law The infringing acts further violate French Intellectual Property Code (Code de la propriété intellectuelle), including in particular: Articles L.513-4 and L.521-1 – Exclusive rights of the registered design owner and acts constituting infringement Articles L.521-2 and L.521-3 – Civil enforcement measures, including injunctions and damages for design infringement C. Amazon Platform Policies The infringing listing clearly breaches Amazon’s internal rules, including: Amazon Intellectual Property Policy – Prohibiting the sale of products that infringe registered design rights Amazon Anti-Counterfeiting and IP Enforcement Policy – Prohibiting unauthorized use of protected intellectual property Amazon’s obligation to remove infringing listings upon notice from the lawful rights holder 3. Formal Request to Amazon As the rightful owner of the EU-registered design, I hereby formally request that Amazon: 1. Immediately remove and disable the infringing listing (ASIN: B0FDJFLTSV) from Amazon.fr 2. Conduct an internal investigation and apply appropriate enforcement measures against the infringing seller (Seller ID: A33KUGQRFA9OJK) 3. Confirm the removal in writing 4. Reservation of Legal Rights If this matter is not resolved promptly and effectively, I will be compelled to enforce my design rights before the competent French courts specialising in intellectual property matters and/or the EU Community Design Courts, seeking full legal remedies including injunctive relief, damages, and recovery of legal costs. 5.
