This Investigation does not present a situation in which the Commission, the parties, or the public should expend the time or resources to undertake discovery and trial on the public interest before the presiding Administrative Law Judge (“ALJ”). As detailed herein, issuance of the relief requested will not adversely impact the public health, safety, or welfare conditions in the United States; competitive conditions in the United States economy; the production of like or directly competitive articles in the United States; or United States consumers. To the contrary, it will positively impact the public interest by protecting intellectual property and patent rights and barring the importation of unauthorized displays used as replacement parts that are lower-quality copies of Complainant’s patented products. The requested remedial orders will provide effective relief from the ongoing patent infringement by Proposed Respondents and will address Proposed Respondents’ unfair competition. As the Commission has stated, “[T]he public interest favors the protection of U.S. intellectual property rights by excluding infringing imports.” 1 Accordingly, issuing the requested remedies in this Investigation will serve, not impair, the public interest. I. How the Accused Products Are Used in the United States The Accused Products are certain active matrix organic light-emitting diode (“AMOLED”) display panels and modules that are used as replacement displays, and components thereof, which infringe one or more claims of the Asserted Patents, as further defined in the Complaint herein. Organic light-emitting diode (“OLED”) displays contain pixels made of organic materials that emit 1 Certain Electrical Connectors & Prods. Containing Same , Inv. They are incorporated by original- equipment manufacturers into a variety of devices, such as smartphones, televisions, and computers. Complainant has innovated AMOLEDs that confer numerous advantages such as superior image quality, higher brightness, wider color range, better contrast, faster refresh rates, increased thinness, and lower power consumption. The Accused Products are used to replace the AMOLED display that comes installed in a smartphone or other mobile device, generally following damage to the device. This use does not raise a public interest concern should remedial orders be issued. II. No Public Health, Safety, or Welfare Concerns Relating to the Requested Remedy The requested remedial orders would not adversely affect public health, safety, or welfare in the United States. Specifically, the Accused Products, AMOLED display panels used as replacement displays, are not medical or health devices, are not otherwise health-related, and are not essential for public health or welfare. The proposed remedial orders would not impact the importation of smartphones, tablets, or other end-user devices containing AMOLED displays. Moreover, as explained below, consumers would continue to be able to obtain replacement AMOLED displays if remedial orders issued. III. Complainant Makes Like or Directly Competitive Products that Could Satisfy Consumer Demand Complainant makes like or directly competitive products—indeed, higher quality articles—that it supplies to mobile phone manufacturers who offer repair services to consumers in the United States. Complainant’s products can continue to be supplied to the U.S. market following the issuance of remedial orders. SDC has been a pioneer in AMOLED displays, and its innovation – 4 – has been largely responsible for bringing this technology to the U.S. market. 2 Consumers would thus still be able to purchase like or directly competitive articles if a remedy issued. IV. Complainant Has the Capacity to Replace the Volume of Articles Subject to Remedial Orders within Commercially Reasonable Time As explained above, SDC is considered the market leader in OLED displays, including in the U.S. market. SDC has the capacity to produce, and does produce, millions of displays each year that utilize the technology of the Asserted Patents. These displays have been used, and can continue to be used, in mobile phone manufacturers’ authorized repair services. Consumer demand for OLED displays would be met within a commercially reasonable period of time through authorized channels. 3 V. The Requested Remedial Orders Would Not Adversely Impact Consumers As stated above, if Proposed Respondents’ infringing products were excluded from the U.S. market, consumers would not be adversely impacted, as sufficient manufacturing capacity exists to assure demand is met for OLED displays used as replacement displays, that could be (and currently are) supplied through authorized channels. In fact, the proposed remedial orders would protect U.S. consumers by excluding sub-standard products from the market.
