This book documents the inaugural public lecture of Honorary Professor Dr. Murad Erdemir, held on May 28th 2014 in the auditorium of the University of Göttingen. Murad Erdemir is the Vice Director and General Counsel in the Hessian State Authority for Commercial Broadcasting and New Media (LPR Hessen). His inaugural lecture looks at human dignity as a central concept of law and ethics. The lecture covers the media law review and also the supervisory practices of the State Media Authorities and the German Press Council. Murad Erdemir, im Hauptamt stellvertretender Direktor und Justiziar der Hessischen Landesanstalt für privaten Rundfunk und neue Medien (LPR Hessen), beschäftigt sich in seiner Antrittsvorlesung mit der Menschenwürde als Zentralbegriff von Recht und Ethik. Dabei konkretisiert er deren Schutzbereich im Hinblick auf die medienrechtliche Bewertung und benennt anhand der Aufsichtspraxis der Landesmedienanstalten und des Deutschen Presserates mögliche Verletzungskategorien. Die im vollen Wortlaut abgedruckte Rede wurde vom Referenten um Gliederungsüberschriften sowie Fundstellen und Vertiefungshinweise ergänzt.

Obwohl in fiskalföderalen Systemen Konsens über die Vorteilhaftigkeit der dezentralen Bereitstellung öffentlicher Güter besteht, zeigen sich große Unterschiede bei der Ausgestaltung von Finanzausgleichssystemen. Diese Unterschiede werden hier aus dem Blickwinkel der Anreizwirkungen analysiert. Dabei zeigt sich, dass die Anreizwirkungen wesentlich von der Informationsverteilung zwischen den Akteuren abhängen. Das Buch diskutiert sowohl die «Theorien der ersten Generation» ohne Informationsasymmetrien und unter Annahme eines wohlmeinenden Sozialplaners, als auch die «Theorien der zweiten Generation» mit Informationsasymmetrien und eigennützig handelnden Akteuren. Auf Grundlage dieser Erkenntnisse wird abschließend ein anreizeffizienter Finanzausgleich bei Informationsasymmetrie entworfen.

The first genocide of the twentieth century, though not well known, was committed by Germans between 1904–1907 in the country we know today as Namibia, where they exterminated hundreds of Herero and Nama people and subjected the surviving indigenous men, women, and children to forced labor. The perception of Africans as subhuman—lacking any kind of civilization, history, or meaningful religion—and the resulting justification for the violence against them is what author Elizabeth R. Baer refers to as the “genocidal gaze,” an attitude that was later perpetuated by the Nazis. In The Genocidal Gaze: From German Southwest Africa to the Third Reich, Baer uses the metaphor of the gaze to trace linkages between the genocide of the Herero and Nama and that of the victims of the Holocaust. Significantly, Baer also considers the African gaze of resistance returned by the indigenous people and their leaders upon the German imperialists.
