In addition to complying with legal duties you shall adopt the standards detailed within this document as a minimum requirement and ensure that they are considered in your submissions. Failure to comply may jeopardise your company continuing to work with Majid al Futtaim. It is the responsibility of the contractor, consultants, and designers to communicate the content of this document to persons under their control and be satisfied that it is strictly followed. All references to the contractor shall, where applicable, be deemed to include all sub- Contractors’ employees and others under the contractor’s control and who have access to the place(s) of work. Agency staff and the self-employed are to be regarded as ‘sub- Contractors’ for the purposes of this document. Nothing in this document in any way relieves the contractor or modifies the legal and contractual obligations to Majid Al Futtaim under the contract agreement be they expressed or implied. All references to contractor refer to the main contractor as defined in the contract and local legislation. These key health and safety standards are mandatory on all Majid Al Futtaim Properties construction projects. These standards will be audited in accordance with set performance measurement procedures, as per specific audit schedule completed for every project. Poor or non-compliance with these standards may result in the contractor being removed from the employer’s approved contractor database. Other purposes are listed below. Where current legislative, guidance or best practice requires enhancement or particular guidance is required does not exist. Advises the interfaces between, consultants, designers, and the contractor and any other stakeholder who enter into a contract with PM COE. Details some of the processes by which all stakeholders shall manage Health and Safety issues while conducting the work under a particular contract, project, or site. Describes by reference, the practices and procedures for Health and Safety performance and associated reporting mechanisms. 1.4 Application of the Requirements There shall be no activity associated with any particular contract or project site which is exempt from the requirements of existing local legislative requirements and any particular elements required of this document. 1.5 The Health and Safety targets, goals and aims are: Zero lost time or reportable injuries. Zero reportable environmental incidents All personnel inducted. Achievement of 95% in PMCOE project audits Reward and recognise good performance. Visibly commit to health and safety from leadership All construction supervisors have health and safety training applicable to this role. Total compliance with inspections and audit 100% incident recording and reporting 100% transparency 1.6 Legislative and Other Compliances General MAFP - HSMS - PM - COE - P01 R e v 6 November 202 4 Page 10 of 142 PM COE EMPLOYER’S HEALTH AND SAFETY REQUIREMENTS Procedure HEALTH AND SAFETY Procedure No. MAFP - HSMS_PM - COE - P01 Employers Health and Safety Requirements Owner PM COE Issue Date Oct 2018 All delivery partners engaging in construction works shall do so in accordance with PM COE health and safety Employers Requirements and all applicable legislations guidelines listed below. It is however envisaged that from time-to-time legislative requirements will change as well as best practice and working practices. The minimum expectations of compliance are detailed below with other specific requirements detailed within each section of this document. Occupational Health and Safety Standard -ISO 45001 National laws, decrees, ministerial decisions, and orders National health, safety, and environmental regulations and codes of practice applicable to the country the project is to be developed. Contractually specified international standards and codes of practice Relevant manufacture instructions and guidelines Contractual standards, procedures, and work instructions Applicable British Standards Institute and International Standards as required and referred to in this document. To follow and to comply with the local rules and regulation of which this document is bound of. Best Practice Guidance CDM Where a conflict exists between specific requirements referred to in this document the higher requirement will be adopted 1.7 Health and Safety Non-compliance Without prejudice to the provisions of the contract, in the event non-compliance, and the failure continues and/or the contractor fails to take any necessary improvement measures to rectify the non-compliance, PM COE are entitled to deduct up to a maximum of AED 5000 per day (or the local equivalent of) from any payment due to the contractor after the expiry of the two (2) day period until the failure has been remedied and accepted by PM COE. This deduction of a maximum of AED 5,000 (or local equivalent) per day represents the extra supervising and administrative work that may be involved by the consultant, CA, or PM COE arising as a result of the failure of the contractor to comply with the above requirements and will not be regarded as a penalty. Notwithstanding the foregoing, PM COE must issue the relevant notice under the contract to the contractor to make good the failure and to remedy it within a specified reasonable time before the further proceeding of the Works. Copies can be obtained from the contract management team. 3 Designer, Consultants and The Contractor’s Responsibilities Note that the term ‘Contractors’ below covers sub-contractors tenant fit out contractors and other contractors working on or for a project for which the main contractor has overall responsibility Or designers working on any part of design work prior to the project mobilising for construction. 3.1 Designers 3.1.1 Design for Safety This standard describes the rules or principles which are required to be adopted. 3.1.2 Scope This standard applies to any design work undertaken for Majid Al Futtaim PM COE. 3.1.3 Purpose To explain how to identify the possible health and safety risks during the design phase and to eliminate, minimise or mitigate residual risks by undertaking design reviews. 3.1.4 Definitions and Notes Designer – any person who undertakes design and includes: o Architects, Civil and Structural Engineers, Building Services Engineers, Building Surveyors, and other design disciplines. o Anyone who specifies or alters a design, particular method of work or material. o As appropriate, purchasers of materials, contractors carrying out design, temporary works engineers and anyone specifying or designing how demolition, dismantling work, structural alteration, or formation of opening is to be carried out. Contract Head – the person who is appointed to ensure the successful delivery of the contract to the Client. Design Manager – the person who is appointed to ensure the successful delivery of the design. Design Team Leader – the person who is appointed to lead the design process. Temporary Works – any temporary structure required to construct a permanent structure or used to support a permanent structure, during its erection, until it becomes self-supporting. Delivery Partner – Collective term for all Clients, Consultants, Contractors, and other organisation involved in delivery of a project for PM COE. 3.1.5 Associated Documents Bahrain occupational Health and Safety regulations (OHS) 1976 Bahrain decree Law No 23 1976 Construction Design and Management Regulations 2015 UK (CDM). Bahrain Ministerial order No 8 of 2013 All applicable local laws and standards of the country where the project is located. 3.1.6 Standard A. Introduction The effective management of the design process should ensure that health and safety is adequately considered for all aspects of the lifecycle as part of the overall project management process, including (as necessary) engineering safety, to meet international and local health and safety legislative requirements. This standard applies for all “design service” whether using an internal or external designer, including temporary works design and design procured through the supply chain. This standard detail how design shall be managed to ensure proper considerations are given to health and safety issues, and to ensure that hazards are identified, and residual risks mitigated to a minimum. B. The objectives of this standard are to ensure: All designers comply with the relevant design requirements of local legislation. Health and safety hazards and risks are identified, mitigated, or managed. The required roles and responsibilities to deliver a safe design are implemented. C. Responsibilities This standard applies to any project whether in-house or via a 3rd-party external design service. MAFP - HSMS - PM - COE - P01 R e v 6 November 202 4 Page 13 of 142 PM COE EMPLOYER’S HEALTH AND SAFETY REQUIREMENTS Procedure HEALTH AND SAFETY Procedure No. MAFP - HSMS_PM - COE - P01 Employers Health and Safety Requirements Owner PM COE Issue Date Oct 2018 Consequently, design consultants have a responsibility to ensure that the following elements are considered as part of the overall process to ensure that projects accommodate the technical management of health and safety issues in the design: o A Design Manager must be appointed to manage the design process. o All Designers must be an existing preferred or approved Supplier on the Majid Al Futtaim Supplier database. Any new Designers must be approved before commencing any design work on behalf of Majid Al Futtaim PM COE. Where design is provided by a 3rd party, e.g., a client, then a review of design competence should be undertaken. o All designers must only be engaged through a formal Design Agreement. During the early stages of the design process, an appropriate business procedure must be in place to ensure the requirements of this procedure are effectively implemented. o A design program shall identify all design activities along with their durations and key dependencies / deliverables, which should be integrated into the overall project program. o The Design manager is responsible for preparing the Health and Safety File and is ultimately accountable to the client. To this end, the Design manager should agree, as soon as possible after the appointment, the structure and format of the file. o The Design manager acts as a coordinator - soliciting contributions to the file from the wider project team, particularly the Principal Contractor. o The Designer manager also has responsibilities to review and revise the information to ensure it is kept up to date as a project progresses. o The Principal Contractor will supply appropriate information to the Principal Designer for inclusion in the file. If the Principal Designer's role finishes before the project does then the Principal Contractor will take on responsibility for the Health and Safety File and passing it over to the client. The Contractor has no duties, under CDM, in relation to the Health and Safety File. o Reviews shall be held at the transition between key project phases. o Where necessary, projects shall report design progress and performance monthly. o A Design Change Management standard shall be produced and adhered to. Design Managers are responsible for managing design changes in relation to the whole lifecycle of the project. Whilst the Design Manager cannot defer responsibility, they may delegate responsibility for individual elements of the procedure to others in the project team, providing any such delegation is recorded in the Design Management Plan. PM COE will undertake periodic audits to verify that Design Managers are complying with the requirements of this procedure, and that a process is in place to ensure that best practice is shared and communicated across the business. D. Project Requirements MAFP - HSMS - PM - COE - P01 R e v 6 November 202 4 Page 14 of 142 PM COE EMPLOYER’S HEALTH AND SAFETY REQUIREMENTS Procedure HEALTH AND SAFETY Procedure No. MAFP - HSMS_PM - COE - P01 Employers Health and Safety Requirements Owner PM COE Issue Date Oct 2018 The Design Manager shall produce and maintain a design management plan, including design changes and variations. Only competent designers, with respect to their design competence, are to be used and that sufficient resources are available on the project to discharge any local legal responsibilities. This includes both lead consultants as well as the contractor designers. Ensure that information relating to the existing environment, any previous relevant health and safety information, if available, is provided by the client at the earliest stages of the project. The Design Manager shall ensure that all such information received is distributed and made available to the project design team. E. Designing for Safety Process Health and safety objectives and targets: The Design Manager shall ensure that the design team identify suitable health and safety objectives and targets at the early stages of the design process. These may be based on local or national campaigns, PM COE targets or project specific targets. Design risk assessment: The Design Manager shall ensure that designers have a robust process in place for the identification of hazards and mitigation of risks associated with their designs. It should focus on the hierarchy of risk by applying the principles of “Eliminate, Reduce, Isolate and Control,” (ERIC). This process should commence at the earliest stages of design with regular reviews incorporated into the design development programme. The Design Management Plan should include a process to record that appropriate design risk reviews are being undertaken and reference documents where key health and safety information and control measures are being recorded for verification and audit purposes. F. Communicating Information Designers are required to include adequate health and safety information with their designs. This includes information about hazards that remain in the design, and the resulting risks. These should focus on the significant issues that are: o Not likely to be obvious to a competent contractor or other designers from the drawings or specifications; or o Unusual, o Likely to be difficult to manage effectively on site. o Residual hazards relating to maintenance and demolition. All information should be presented in a clear, precise, and consistent format. The Design Manager shall agree an appropriate method to communicate design information. This may be through a variety of ways, but the following represents the minimum requirement on all projects: MAFP - HSMS - PM - COE - P01 R e v 6 November 202 4 Page 15 of 142 PM COE EMPLOYER’S HEALTH AND SAFETY REQUIREMENTS Procedure HEALTH AND SAFETY Procedure No. MAFP - HSMS_PM - COE - P01 Employers Health and Safety Requirements Owner PM COE Issue Date Oct 2018 o Hazard and risk registers are developed as a means of recording significant hazards and the risk mitigation measures being implemented by designers. Their value lies in providing a simple tool to record ongoing design development issues and key decisions. o They should not be used to record generic information on common construction site hazards that a competent contractor would be expected to be aware of. Hazard registers should record both positive and negative issues and record key information about how significant hazards have been designed out. They also provide an auditable trail for verification purposes. o Where appropriate key health and safety information shall be included on drawings; typically, construction issue drawings or as built drawings; information should: Include details of significant residual hazards or risks and critical design assumptions. Be activity specific rather than generic or site specific. Relate to design rather than the existing environment. Be descriptive rather than prescriptive. Cross-reference any supporting documentation. G. Critical Design Information Designers are required to provide information for pre-construction activities such as tendering and for those who will be using and/ or maintaining the building / structure after construction is complete. The Design Manager should agree with all relevant parties at the start of design what information is required and in what format. The operator, if known, should also be consulted. As a minimum, this should include: o General principles of the design o Information on the existing environment o Relevant site logistics information o Significant construction assumptions o Cleaning and maintenance strategy o Fire strategy. o Building façade repair and replacement strategy o Plant repair and replacement strategy. o Decommissioning and demolition strategy As built information o The Design Manager or Design Team Leader will coordinate this information. o All design work shall be undertaken with due regard to the hazards and risks associated with temporary works. H. Monitoring and Review MAFP - HSMS - PM - COE - P01 R e v 6 November 202 4 Page 16 of 142 PM COE EMPLOYER’S HEALTH AND SAFETY REQUIREMENTS Procedure HEALTH AND SAFETY Procedure No. MAFP - HSMS_PM - COE - P01 Employers Health and Safety Requirements Owner PM COE Issue Date Oct 2018 All projects shall establish a mechanism for reviewing design information on a regular basis. This would typically be done through appropriate design reviews at key stages in the project process and should be defined in the Design Management Plan. Monthly Health and Safety Design workshops are to be held, these are to discuss Health and Safety Risks as the design develops, these risks may be during construction or residual risks to the operator or maintenance team. On large and more complex projects, additional reviews prior to commencing construction or commissioning shall be undertaken in conjunction with the appropriate contractors or commissioning engineers. I. Reporting In order to capture valuable information and feedback to designers, the project management systems shall have a process to ensure the contractors/ sub-trades are engaged in providing feedback on buildability issues during construction. Where appropriate a project close out meeting on design issues should be undertaken to record any significant issues to be addressed on future projects. A post occupation, completion or in-service review shall be undertaken by the Design Manager with the end user / maintainer at the end of the contract defects liability period to identify any significant health and safety issues for future operational or maintenance design considerations. The review should ensure any learning feedback or best practice is communicated, as appropriate, to design teams involved in future similar projects. Construction Supervision Consultant (Architect of Record and/or Consultant Engineer (AOR) 3.1.7 General Requirements Construction supervision Consultants employed on PM COE projects are required to lead by example in delivering best practice in health and safety management on our developments. The duties and responsibilities of construction supervision consultants include, but are not limited to, the following. Communicate the Health and Safety policy, requirements, objectives, and goals to all contractors working under their supervision. • Inspect and monitor the works to ensure that all health and safety standards are being met. • Support the project managers in delivering the required health and safety standards and performance. • Investigate and report accidents and incidents in accordance with the accident and incident reporting procedure. • Monitor welfare facility standards and report non-conformance to the employer, as required. • Monitor contractor’s health and safety performance. • Ensure that all workers are given site inductions and further information and training needed for the work. • Consult with the workers. • Liaise with the employer’s Project Manager and design consultant regarding ongoing design health and safety issues. • Ensure that a project specific Health and Safety Plan is developed in accordance with employer’s requirements for the scope of their services, detailing the specific arrangements of how they will manage, monitor, and supervise the contractor, as well as administer and implement the employer’s Health and Safety requirements. • Employ a sufficient number of competent Health and Safety staff in line with the legal requirements and the employer’s health and safety requirements, together with the necessary tools and arrangements to perform their duties appropriately. • Ensure that the contractor provides a sufficient number of competent Health and Safety staff and personnel in Health and safety critical roles, as per the employer’s Health and Safety requirements for contractors. • Ensure that adequate Health and Safety information is disseminated and communicated to make the workforce aware (in their own language) of any hazards, risks and control measures associated with their work. • Ensure that both contractor and subcontractor, develops and implements an adequate Health and Safety training program for staff and workforce. MAFP - HSMS - PM - COE - P01 R e v 6 November 202 4 Page 18 of 142 PM COE EMPLOYER’S HEALTH AND SAFETY REQUIREMENTS Procedure HEALTH AND SAFETY Procedure No. MAFP - HSMS_PM - COE - P01 Employers Health and Safety Requirements Owner PM COE Issue Date Oct 2018 • Monitor and supervise the contractors Health and Safety performance to ensure compliance with Legal, Contractual and Employer requirements, and report any deficiencies to the employer. • Ensure that their personnel, and those of all Project Parties, always adhere to the HSE Regulations of the programme and play a proactive role in reporting and eliminating hazards onsite. • Ensure the availability, suitability, and adequacy of the HSE Plans and associated documentation by all the contractors/subcontractors working under them and approve as required. • Ensure that any plant and equipment provided by the contractor and supply chain and in use meets legal and employer’s requirements, is in serviceable condition, fit for purpose and operated by trained and competent personnel. • Continuously monitor the Health and Safety performance of the contractor and their supply chain, regularly appraise their effectiveness making sure that any Health and Safety non-conformances are rectified in a timely manner and that appropriate protective and preventative controls are always maintained in place. • May direct the contractor to suspend all or part of the works until satisfactory corrective action has been taken if the contractor fails to take corrective action to mitigate any risks. • In case of serious safety violation, be entitled to issue a stop-of-work order countersigned by the employer, which shall be treated as a suspension pursuant to Sub- Clause. • Report to the employer on a regular basis on the HSE performance of all project parties, including a submittal of a monthly Health and Safety report and statistics. • Provide leadership, direction, guidance, and technical assistance to the contractors in relation to the Health and Safety requirements and standards as required. • To achieve the aims of this task, the following specific services will be provided by the consultant: • Administer and lead the implementation of the behavioural based Safety Schemes for example Don’t Walk By – Observe, Engage, and Improve). • Participate in employer led Health and Safety leadership tours, workshops and meetings as required. • Carry out Health and Safety pre-start meeting with contractors as per the employer’s agendas. Develop and lead HSE planning/review workshops with contractor and employer. Set up health and safety in design workshops. • Develop contractors HSE Plans/MS/RA submission plan based on programmed activities. • Ensure that the contractor develops and issues a project specific Health and Safety and associated plans in accordance with the employer’s Health and Safety requirements. • Review, approve, monitor the implementation of and audit the contractor’s documentation (not limited to: HSE plans, Method Statements, Risk Assessments, material submissions, equipment certification, and any other health and safety related submissions) for compliance with legislation and employer’s requirements. • Carry out monthly document review of selected contractor’s documentation. • Review contractor designs for Health and Safety Design requirements and assessments. • Carry out daily unsafe act/condition observation reports. Intervene as required to resolve nonconformance’s and unsafe practices. • Carry out joint weekly Health and Safety Inspections with contractor’s personnel. Chair weekly HSE meetings with contractors Health and safety team and Management. • Carry out monthly topic specific contractor audits. • Carry out quarterly compliance audits of contractors. • Carry out monthly assessment of contractor’s onsite performance. • Ensure that all accidents/incidents and near misses are reported and investigated in accordance with the employer’s protocols. Review reports and provide technical support, guidance and recommendations as required. • Produce a monthly Health and Safety progress report, to include but not be limited to executive summary, accident/incident performance, trend, and route cause analysis, KPI performance, actions required, best practice, lessons learnt, and look ahead. • Ensure contractors develop and implement reward and recognition schemes. • Lead interviews of contractor’s Health and Safety staff (in conjunction with the employer) – recommend for approval to employer as required. • Ensure contractor produces Health and Safety file as per employer’s requirements. MAFP - HSMS - PM - COE - P01 R e v 6 November 202 4 Page 20 of 142 PM COE EMPLOYER’S HEALTH AND SAFETY REQUIREMENTS Procedure HEALTH AND SAFETY Procedure No. MAFP - HSMS_PM - COE - P01 Employers Health and Safety Requirements Owner PM COE Issue Date Oct 2018 • Assist in delivery of employer’s training programmes as required. • Track and verify all Health and Safety related data submitted by the contractor. • Ensure pre-access to site plant and equipment checks are carried out. • Ensure contractors hoardings, security arrangements and site set-up meet employer requirements. • Ensure that adequate emergency arrangements are in place onsite and in-site offices. • Interface, liaise, and coordinate with contractor and employer’s Health and Safety depts. 3.1.8 Contractors and sub-contractors A. The contractor shall be solely and fully responsible for compliance with the employers, and regulatory requirements applicable to the health and safety of persons, visitors, activities, and the public during the performance of the Works. PM COE reserves the right to review the contractor’s health and safety program/record and periodically inspect work sites for compliance with the requirements described in this section and the contract documents. Non-compliant items will be reported to the contractor for their corrective action. Items found to have a high risk of creating an incident will result in issuance of an “Non- conformance notice “or a stop work notice. This notice will remain in force until the PM COE health and safety manager is satisfied that the risk has been abated. PM COE requires that its operations are implemented in such a way as to ensure the health, safety, and welfare of all its employees and all persons likely to be affected by its operations including sub-contractors, non-employees of Majid Al Futtaim and members of the public. A pre-commencement meeting is held with every contractor at which contract specific requirements including attendances are discussed and agreed. The meeting also reviews the detailed arrangements to ensure the contractor complies with the requirements of this document. The contractors and any sub-contractors working for Majid Al Futtaim are required to co-operate with discharging responsibilities and must therefore ensure that Majid Al Futtaim or their supervising consultant receives the following information within 30 days following award of contract: o The contractor’s health and safety management plan o Construction Environmental Management Plan (CEMP) o Waste management Plan. o Mobilization and De-Mobilization Plans
