Ramesh Kumar dis qualifi ed three rebel legisla tors with immediate eff ect till the end of the 15th Vidha na Sabha. Speaking at a press confe rence late on Thursday, Mr. Ramesh Kumar promised to take a decision on the resig nation of the 13 other rebel legislators “in the next cou ple of days”. He added, “I know this matter will go to court.” The Speaker disqualifi ed Congress legislators Ramesh L. Jarkiholi and Mahesh Ku mathalli, representing the Gokak and Athani consti tuencies in Belagavi district, and KPJP legislator R. Shan kar, representing Raneben nur in Haveri district, under the Tenth Schedule of the Constitution. Mr. Shankar had merged his party with the Congress just last month. The disqualifi cation of the three MLAs, which is open to judicial review, brings down the strength of the As sembly to 222, including the nominated member. The Speaker’s decision adds a new dimension to the already fl uid situation. While the CongressJD(S) coalition has already been voted out, the BJP is yet to stake claim to form the next government. “They have been disquali fi ed with immediate eff ect and till the expiry of the le gislative Assembly (2023 or otherwise, if dissolved ear ly). They cannot enter the 15th legislative Assembly again,” the Speaker said. The disqualifi cation was initiated against them under paragraphs of 2 (1) (a) of the Tenth Schedule, read with Article 191(2), he added. On party’s complaint While the disqualifi cation proceedings against Mr. Jharkiholi and Mr. Kumath alli have been initiated based on the Congress’s pe tition against them on Fe bruary 11, the proceedings against Mr. Shankar are based on the party’s com plaint on July 7. Over the last two days, af ter the collapse of the 14 monthold H.D. Kumaraswa myled government, all eyes were on the Speaker’s deci sion on the resignation of the rebel legislators and the disqualifi cation proceedings initiated against them. Mr. Ramesh Kumar said: “I will be taking a decision on the resignations of [the 13 other] rebel MLAs in a cou ple of days.” Though he acknowledged that the antidefection law could not be used by parties to throttle internal democra cy, Mr. Ramesh Kumar, ho wever, cited the judgement of VicePresident M. Ven kaiah Naidu in the case of former minister and JD(U) leader Sharad Yadav’s dis qualifi cation from the Rajya Sabha, and the disqualifi ca tion of 18 AIADMK legisla tors in Tamil Nadu after they approached the Governor. “Whatever Karnataka re bel legislators told the Su preme Court, they could have told the same thing to the government,” he said, referring to the charges that the rebels made against the government in their affi da vits fi led in apex court. “The party’s decision is collective. If individuals have a problem, they have to raise the issue within the party. It is a settled law and there is clarity (on this is sue),” Mr Ramesh Kumar said. A Bench, led by the Chief Justice of India, ordered that the courts be set up within 60 days. They will be esta blished under a Central go vernment scheme. This means that the Centre will fund everything from the payment of the pre siding offi cers, staff and sup port persons to the court’s childfriendly infrastruc ture. Of the 1.25 crore VVPAT slips counted, 51 or 0.0004% of the total saw a mismatch, according to facts shared by the EC on July 21. The EC on Wednesday or dered the Chief Electoral Of fi cers to analyse the mis matches. For one of the cases pertaining to Manipur, the enquiry team was not set up as an election petition has been fi led, an EC offi cial said on Thursday. Another EC source said the teams were given 10 days to analyse the mismatch. The orders cited a May 21 letter by the EC that said tho rough probes would be con ducted in case of a mismatch between VVPAT slips and EVM count to ascertain the technological, procedural, systemic and human errors or lapses in compliance. These could include the pos sibility of returning offi cers not clearing the mock votes and manual errors while tal lying the VVPAT slips. The mismatches mark the fi rst time there were any, since VVPAT recounts were implemented in the 2017 As sembly elections. Under the electoral rules, if there is any discrepancy in the match, the VVPAT count prevails. The Opposition staged a wal kout during the vote on its motion to send the legisla tion for scrutiny by a Select Committee, accusing the go vernment of trying to sabot age the vote. The Bill, cleared by the Lok Sabha on Monday, seeks to bring in changes involving the salaries and tenures of Information Commissioners in the States and at the Centre. The Opposition mo tion was defeated 75 to 117 in favour of the government. This is a rare occasion in the Rajya Sabha that an Opposi tion motion was defeated. The BJPled NDA is slowly in ching towards a majority in the Upper House. Procedure violated The ruckus began when CPI (M) member Elamaram Ka reem accused BJP MP C.M. Ramesh of collecting the bal lot papers from other mem bers, instead of allowing the marshals to do so. Mr. Ra mesh had recently switched to the BJP from the TDP. Speaking to The Hindu, Mr. Kareem said he fi rst heard Mr. Ramesh instruct ing TDP MP Thota Seetarama Lakshmi, who sits next to him, on how to vote. “Once the ballot papers were distributed, Mr. Ra mesh came down to collect her ballot. He also had other ballot papers with him. It is not a member’s job to collect the ballot papers — it is for the marshals to do so. That is when I protested and drew the attention of the House to what was blatantly wrong,” Mr. Kareem said. The other Opposition members informed Deputy Chairman Harivansh, who was in the chair, of the wrongdoing and demanded a repoll. The Chair, howev er, did not respond to the al legations. At this, Opposition members stormed into the well, raising slogans. Angry Opposition leaders then staged a walk out. In ab sence of the Opposition, Mr. Harivansh announced the re sult of the ballot. The Bill was then passed by a voice vote. “What happened today is the ultimate insult to the dig nity of the Rajya Sabha. The reservoirs, which will be created between Palla and Wazirabad, will store water overfl owing from the Yamuna during monsoons and help recharge the groundwater. This will help tackle water crisis in the Capital. Imposes conditions A Bench headed by NGT Chairperson Justice A.K. Goel said, “In view of the fact that the project is not ex pected to disturb the main direction of this tribunal for rejuvenation of river Yamu na and is to be executed sub ject to the conditions im posed by the committee, the same may proceed in accor dance with law subject to any challenge thereto.” An NGTappointed princi pal committee had imposed conditions to be taken into consideration during the ex ecution of the project. “The proposal is to be car ried out as a pilot project at one location only to study the technoeconomic viabili ty and to identify the quan tum of groundwater re charged. Suffi cient safeguards need to be built for implementation of the project to ensure that no misuse takes place through unauthorised activities such as extraction of sand and other natural resources,” the Bench noted while referring to the panel’s conditions. Currently, the city faces a water shortage with a re quirement of about 1,120 million gallons per day (MGD) and an average water production of about 900 MGD, which peaks to 935 MGD on certain days. This is mainly due to the nonavaila bility of raw water. The Delhi Jal Board gets a major share of its water from Haryana and Uttar Pradesh and about 80 MGD from borewells in the city. “No construction or use of cement will be involved and regular fl ow of Yamuna will not be touched,” Mr. Kejri wal had earlier said about the project. “The massive project, which could change the wa ter scenario of Delhi, got all the clearances in a short span of 45days. It has be come possible only because of the constant monitoring and pursuance of the CM that several important clea rances were receieved at such a fast pace,” a govern ment statement said. The petition, by BJP leader and lawyer Ashwini Kumar Upadhyay, claimed that “cash transaction in high denomination currency is used in illegal activities like terrorism, separatism, radicalism, smuggling, money laundering, kidnapping, extortion and bribery”. The Hindu had reported on Sunday that illegal plastic segregation and melting un its were operating on resi dential and agricultural land in the same villages in outer Delhi and also in Haryana. On Monday, the National Green Tribunal (NGT) came down heavily on the Delhi government on the issue. “Even though an actionta ken report has been fi led, the action hardly meets the magnitude of violation. There is no serious exercise of assessing the cost of dam age to the environment and the cost of restoration. It is also not clear whether the polluting activities have been stopped,” the Bench had observed. On Thursday, a team of of fi cials of DPCC, municipal corporation, Delhi Police, Revenue Department and BSES visited about 10 villag es including, Mundka, Tikri Kalan, and Nangloi, where the units were operating, said a DPCC offi cial. “The units operating mainly in plots with boun dary walls. Twentyfour un its were sealed and their electricity connection has been disconnected. Action would continue tomorrow also,” the offi cial added. Imposed penalty In December 2018, the Na tional Green Tribunal had imposed a ₹ 25crore fi ne on the Delhi government for failing to crack down on ille gal plastic markets in Tikri Kalan in Delhi and nearby villages. The incident happened on Monday around 3 a.m. The man, who lived with his family on the ground fl oor of the building, went to the ter race on the third fl oor with his wife and minor daughter. He held his daughter’s hand and jumped, while his wife followed them, the police said. While the man died, his wife and daughter sustained injuries in the incident, the police said. In her statement to the police, the woman said that her husband had several cre dit cards of diff erent banks and had taken a loan of ₹ 8 lakh which he had to repay, they said. He was under stress as the bank offi cials kept calling and messaging him everyday asking him to repay the loan amount, the woman told the police. The police was informed about the incident by some neighbours who spotted the three lying on the road. They were rushed to GTB Hospital where the man was declared brought dead. The fouryear old had suff ered fractures on both her legs, the police said. However, after the wo man jumped from the ter race, she hit an electric wire which broke her momentum due to which she received only minor injuries, a senior police offi cer said. The doctors have said that the woman and her daught er are out of danger and sta ble. The man’s body was handed over to his family af ter a postmortem, the pol ice said. He used to work in a private company in Guru gram and had recently left the job, they said. The building where the fa mily stayed belongs to the deceased’s fatherinlaw, who lives in Punjab, they said. The deceased’s broth erinlaw also lives in the same building. Chandni, a resident of DDA Flats in Sarai Fus area in north Delhi, and her accom plice Mona was arrested in Sarai Rohilla, the police said. Nupur Prasad, DCP (North), said that to keep a check on incidents of snatch ing and robbery, vehicles were being checked in Sarai Rohilla when the policemen on duty at a barricade not iced a man on a motorcycle with a woman riding pillion. The rider was signalled to stop but he took a sharp U turn and unable to maintain the balance, fell on the ground. They were caught and brought to the police station for questioning. “The description of the woman matched with that of a woman who was suspected to be involved in several snatching cases reported at various police stations in north Delhi. During ques tioning, they broke down and confessed to having been involved in those cas es,” said Ms. Prasad. Ms. Prasad said that Chandni was the master mind of the gang and used to ride pillion on a twowheeler which one of her accomplic es would ride. She used to commit snatching while the male members of the gang were assigned the task to steal vehicles for the job. “Chandni, a school drop out, had come in contact with a group of snatchers in her locality. She was good at her job and soon turned out useful for the gang,” said Ms. Prasad. Ms. Prasad added that with the arrests, they have worked out three cases of snatching and three cases of vehicle theft reported in the city. A case of cheating was re gistered in March after BCCI’s regional integrity manager of its AntiCorruption Unit, An shuman Upadhyay, said that they had received complaints from Kanishk Gaur and Kish an Attri of Rohini and Shivam Sharma from Gurugram, the police said. Mr. Kanishk told the police that he was approached by a cricket coach last year who duped him of ₹ 11 lakh. He said the coach had promised that he would get a chance to play in the Ranji Trophy team of Nagaland as a guest player. However, he said, he was al lowed to play only for two matches of the under19 cate gory from another State as a local player after his birth certifi cate and other docu ments had been forged, a se nior police offi cer said. Mr. Shivam was duped of ₹ 4 lakh on the pretext of get ting him a chance to play in the under23 category, the of fi cer added. The victim had said that the couple was allegedly in volved in fl esh trade and wanted to drag her into it. The victim had become friends with the man, identi fi ed as Radhey, after she met him while returning from Haridwar Kanwar Yatra in 2016. The accused took the victim’s mobile number from her father. They started talking to each other on reaching home. The accused had visited her house after returning from the yatra and also visit ed a nearby temple. ‘Flesh trade’ The accused later proposed her for marriage “with the consent of his wife”. Howev er, when the victim came to know that the couple was in volved in the business of prostitution and wanted to drag her into it, she rejected the proposal. The accused did not give up on her and instead start ed putting pressure on her for marriage. Radhey and his wife Anita then called her to a metro station one day and tried to convince her. When the victim re fused, the man held her hands and his wife threw acid at her that damaged her face and arms. The prosecution said that the accused had stolen the acid from a factory at Bu landshahr in Uttar Pradesh where he was employed. When the factory owner caught him redhanded, he told him that he would use it for cleaning toilet. Though a number of ob jections to the material evi dence were raised, the court rejected those. “The court is of the view that the prosecution has ful ly proved its case against both these accused persons for the off ence punishable under Sections 326A [volun tarily causing grievous hurt by dangerous weapons or means]/34 [common inten tion] IPC for causing acid in juries to the girl by throwing acid and as such, accused persons are held guilty of the off ence under Section 326A/34 IPC and are convict ed accordingly,” Additional Sessions Judge Satinder Ku mar Gautam said in his order. “Both convicts are sen tenced to simple imprison ment of 11 years each with fi ne of ₹ 1,00,000 each. The others against whom Special Judge Bharat Parash ar framed the charges under IPC Sections 120B (criminal conspiracy) and 420 (cheat ing) are D.N. Abrol, Vikrant Gujaral, Anand Goel and Sushil Maroo. The case per tains to allocation of Urtan North coal block in M.P. jointly to JSPL and Monet Is pat and Energy Ltd. The CBI alleged that the accused had acquired the block by misre presenting the facts to the Screening Committee regard ing the end use of the coal. Counsel for the probe agency submitted that on the date of making presentation before the Screening Com mittee, JSPL had admittedly not acquired 964 acres of land for its Jharkhand project and placed orders for pro curing equipment for a sum of ₹ 4,340 crore for its Odisha project. Coal case: charges framed against Naveen Jindal Special Correspondent New Delhi A 45yearold gym owner was allegedly shot at by an unidentifi ed man in north Delhi’s Civil Lines on Thurs day, the police said. The victim, Rahul Gupta, a resident of Naveen Shahda ra, runs a gym in partner ship with his brotherinlaw. He is also a distributor of a washing powder, they said. The incident was report ed to the police around 9.30 a.m., the police said. They said that Mr. Gupta was entering the gym after parking his car outside, when a man shot at him from a distance and fl ed. The accused was wearing helmet. Mr. Gupta sustained a bul let injury in the stomach. He was rushed to a nearby hos pital and his condition is stated to be out of danger, the police added.
