Rules of Terenure Sports Club As adopted by the Executive Committee INTERPREATION AND PRELIMINARY In these Rules the following words and expressions shall have the following meanings unless there is something in the subject matter or context inconsistent therewith: “AGM” means an annual general meeting of the members of the Club. “Articles” means the Constitution of the Club as amended from time to time. “Club” mean Terenure Sports Club. “EGM” means and extraordinary general meeting of the members of the Club. “Executive Committee Members” means a member of the Executive Committee for the time being. “EC” means the members of the Executive Committee for the time being. “General Meeting” means an AGM or EGM as the case may be. “Member” means a person who is admitted to membership of the Club in accordance with the provisions of this Constitution and the Rules. “Rules” means these rules and regulations governing the operation and management of the Club as drawn up by the EC and as amended from time to time by the EC. “Sections” means each of the cricket, rugby, tennis, bowls, football, soccer and table tennis sections of the Club and any other section of the Club which may be established by the EC in future, each of which are managed by the relevant Section Committee f or and on behalf of the EC. “Sections Committees” means the committees of each Section of the Club which are established by the EC and whose committee members are appointed by Members of the relevant Sections to assist with the management of each Section. “Special Majority” means the approval of a resolution at a General Meeting by two - thirds of the Members present and voting on the resolution. 1. CLUB NAME AND COLOURS a. Variations to the Club name used by Sections in competitions may be permitted by the EC. b. The Club colours and those of it’s constituent Sections are Purple, Green and White unless otherwise approved by the EC. 2. RELATIONSHIP BETWEEN CLUB AND SECTIONS I. The terms on which permission to use Club playing fields, facilities, Club premises and social facilities may be provided to any Section shall be decided by the EC, following consultation with the relevant Section, from time to time. II. Each Section approved by the Club (including those which have been approved prior to the entry into this Constitution) shall be structured in a manner approved by the EC. III. The EC shall have power to terminate the operations of any Section of the Club provided it issues the relevant Section Committee 6 months’ notice of the date on which the Section will cease to operate. IV. Each Section shall be required to comply with the following reporting systems, each to be in a format approved by the EC: - a. At least eight weeks prior to the start of the Season for the Section it must submit, for the approval by the EC, it’s plans for the operation of the Section during the forthcoming season, including its budgets for meeting the costs of such plans and also for the payment for the amounts as may be agreed in accordance with 2(v) below. It shall meet with the EC prior to the commencement of the season, after these plans have been submitted, to explain them and answer any questions put by the EC in order that t he EC may determine whether they are suitable for approval. b. At regular intervals during the Section’s season, it shall meet with the EC to discuss their plans and how they have been progressing and, in particular, will submit its financial accounts for the season so far as compared with the budgets submitted pursua nt to (iv) and (a) above. V. In respect of each Calendar year each Section shall be entitled to use the premises and facilities of the Club and subject to the following terms: a. Each Section shall pay to the Club in respect of each calendar year a facility usage fee of such amount in respect of any calendar year as may be decided by the EC, following consultation with the Section. b. The EC shall determine after consultation with the relevant Section Committee the facilities that will be made available to each Section, in return for such facility usage fee, and such period or periods and, within such period, the time or times as during which such facilities will be made available to the Section. The EC shall in respect of such facilities decide what expenditure in respect of the upkeep and any additional work to be done on that facility during the course of the year will be discharged by the Section and what, if any, by the club, following consultation with the Section. c. Any such arrangements entered into in respect of any calendar year shall last for such year only and shall be subject to separate and new negotiations in respect of any further year for which the Section wishes to use such facilities. d. Notwithstanding the provisions of sub article (b) above, in the event that exceptional expenditure requires to be incurred in respect of facilities for a particular Section, the Club and the Section, may, on such exceptional basis, agree an arrangement tha t extends beyond one year and the matters agreed therein shall remain in place for the period covered by such special arrangements. 3. SPORTING ACTIVITIES a. The Club games are such as may from time to time be approved by the EC to be played under the management and control of separate sections (each “a Section”) in accordance with the laws laid down by the accepted ruling bodies governing the particular sport. The current approved sports are Bowls, Cricket, Rugby, Table Tennis, Tennis and Soccer. b. The EC may also authorise the playing or promotion of other sports and activities 4. EXECUTIVE COMMITTEE Any member going forward for election to the EC must be proposed and seconded by Members with full voting rights. Although not a requirement for standing for election, the Executive Committee may invite candidates to circulate information setting out the e xperience and other qualifications which they may bring to the position to which they are seeking election. No member of the EC, Manager or employee shall have any personal interest in the sale of alcohol, food or other commodities sold on the club premise s. 5. SALE OF INTOXICATING LIQUOR The EC shall appoint a Bar Committee with responsibility for the management of the availability and sale of intoxicating liquor on the Club premises and shall make and publish regulations governing the operations of the Bar Committee. The Clubs shall honour the following rules regarding the sale of Intoxicating Liquor: a. A visitor shall not be supplied with excisable liquor in the Club premises unless on the invitation and in the company of a member and the member shall on the admission of such visitor to the Club Premises or immediately upon his/her being supplied with su ch liquor enter his/her own name and the name and address of the visitor in a book which shall be kept for the purpose and which shall show the date of each visit b. No excisable liquor shall be sold or supplied by the club to any person under the age of 18 years. c. No person under the age of 18 years will be allowed into the licensed area of the Club after 21:00. However, a child accompanied by his/her parent or guardian may be allowed into the licensed area between the hours of 10:00 (12:00 Sundays) and 21:00. d. A child who is aged at least 15 years of age but under the age of 18 years and who is accompanied by his/her parent or guardian may be allowed into the licensed area of the Club on the occasion of a private function at which a substantial meal is served to persons attending the function. e. No excisable liquor shall be sold or supplied for consumption outside the Club premises except to members of the club between the hours prescribed by law i.e. 08:00 and 22:00 f. Subject to the exceptions mentioned in Sub sections 2 and 3 of section 56 of the Intoxicating Liquor Act 1927 as amended by section 6 of the intoxicating liquor act 1962, no excisable liquor shall be supplied for consumption on the Club premises to any per son (other than a member of the Club lodging in the Club premises) or be consumed on the Club premises by any person (other than a member of the Club lodging in the Club premise a. On any week day before the hour of 12:00 or b. On any Monday, Tuesday, Wednesday, Thursday after the hour of 23:30 or c. On any Friday or Saturday after the hour of 00:30 of the following day or d. On any Sunday (Except where St. Patricks Day falls on a Sunday) before the hour of 12:30 in the afternoon and after 23:00 or e. On St. Patricks Day before the hour of 12:30 or after the hour of 00:30 of the following day or f. On Christmas Eve before the hour of 12:00 or after the hour of 23:30 or g. At any time on Christmas Day g. Nothing contained in the Registration of Clubs Act 1904 to 1999 or imposed only by the virtue of the operation of rule 21 of this constitution shall operate to prohibit the supplying for consumption on the club premises of excisable liquor to any person fo r the consumption of excisable liquor in these premises by any person: a. On Christmas Day between 12:00 and 22:00 b. On any other day for one hour after the expiration of any period in respect of that day during which it is lawful for the club by virtue of rule 21 of this constitution to supply any excisable liquor for consumption on the Club Premises, if in each case th e excisable liquor is: i. Ordered by that person at the same time as a substantial meal is ordered by him ii. Consumed at the same time as and with the meal iii. Supplied and consumed in the portion of the club premises set aside for meals iv. Paid for at the same time as the meal is paid for. Terenure Sports Club (Formerly CYM) shall comply with all licensing laws as stated above and in accordance with Section 31 Intoxicating Liquor Act 1988 (as amended by the 200 and 2003 acts). 6. FUNCTIONS All functions arranged in the name of the Club on or off the Club’s premises, shall be with the consent and prior permission of the EC. All income from such functions shall be received by the Honorary Treasurer and all expenditures associated with such fun ctions shall be paid by the Honorary Treasurer, or with his/her approval. 7. MEMBERSHIP CARDS Each category of Member (except Junior) shall be provided with a Club Membership Card, on payment of the relevant amount, in force at that time, which shall identify his or her entitlement to be present on the Club’s premises as a Member of the Club. A Mem ber is required to carry his or her card at all times and may be required to produce it by any of the members of the EC or any paid employees of the Club. Club Membership Cards can be used to purchase food or drink on the Club premises and Members will be required to purchase credit of such amount or amounts as the EC may require on such Card. Any such credit shall be forfeited if unused during the membershi p year, however, additional credit purchased may be carried forward. Purchases of food or drink using the Club Membership Card may be available at reduced prices to Club Members. 8. RENEWAL OF MEMBERSHIP The membership year and the Club financial year shall run from 1 st January to 31 st December. Subscription fees for all categories of membership must be paid by 31 st January each year (“Subscription Renewal Date”). The subscription and any relevant Levy payable by each category of Members in any calendar year will be determined by simple majority of the Members voting at Annual General Meeting or Extraordinary General Meetings, on the proposal of the Executive Commit tee. A subscription and/or levy, as so determined, shall remain in force for subsequent years unless and until amended at a subsequent General Meeting.
