Parent case is 23 - 170. 5/11/23 Swainson Phone calls Learned from investigator Pham that sex harassment victim reported to her that Chief Morningstar parked across from her house in uniform/patrol car for approximately 1 hour. Briefed Division Manager Mike Devine of the problem. 1524 hours Called Mayor Dan Mortensen at 360 - 269 - 3057. Mortensen said he knew Morningstar had parked outside victim’s house because victim’s husban d had just called and complained to him. Explained based on my experience in LE, it was very problematic that Morningstar parked in uniform outside of the complaining victim’s house – Mortensen cut me off and explained he had 26+ years in LE and was Chief of Morton – so “cut to the point.” FORM CJTC 1920 2/2022 Certification Division Action Log ☐ Certification Case ☒ Complaint ☐ Reporting Form 1915 Case Number : 23 - 1 70 Officer Name : Morningstar, Roger Agency : Morton PD Assigned: Michelle Pham Told Mortensen to put Morningstar on admin leave immediately, seize his weapon, badge, uniform and other items giving him police power on behalf of the city of Morton. Mortensen said he couldn’t put Morningstar on leav e because he is union, that will be counted as discipline and then he cannot fire him, which he planned to do anyway. Mortensen said Morningstar called in sick today because he twisted his knee, and would be on sick leave on Monday/Tuesday, and when he ret urned he could call him in and then take his next steps. I urged the Mayor to consult with his legal counsel for the city, a prosecutor or retained attorney – whomever, because between his concern over a possible union counter and a sexual harassment vict im being intimidated by a sitting Chief, it isn’t a close debate – If harm comes to the victim/her husband, any surviving family will sue the city of Morton into the stone age with cause. Advised Mayor, this was CJTC telling him, CJTC knows this, and we’ re documenting we know this, and that we’ve told him we know – additionally, Advised the mayor my next call would be to the Lewis County Sheriff’s Office to ensure they know too. Mayor said “I’m on a one on one basis” with the Sheriff of Lewis County, Ro b Snaza, and Snaza knew he was doing a sex harassment case on Morningstar. Mortenson said as soon as we hung up, he would be calling Snaza, suggesting I didn’t need to. I assured Mortenson I would be calling LCSO next. Mayor Mortenson said “I think he” (Morningstar) “is fishing. He knows I’m doing a sex harassment investigation on him.” When asked how Morningstar knew this, Mortenson remarked “I’ve been talking to people saying ‘I’m doing a sex harassment investigation on the Chief,’ so I t hink he’s figured it out and is fishing around.” I asked if Mortenson told people who the complainant/victim was, and he said no. I pointed out it wouldn’t take much to figure it out if he is open ly telling people what he is investigating and it puts the victim in peril. Mortenson asked if we, CJTC told Morningstar who the victim was. – I affirmed CJTC has told no one. Mayor Mortensen restated that the only reason he didn’t put Morningstar on lea ve was because the victim’s husband told him not to. I reminded Mortensen I would notify LCSO next. He said he would call the Sheriff, then maybe his prosecutor. 1536 hours called Lewis County SO FOB Chief Dusty Breen at 360 - 740 - 1327. Voicemail briefin g on the above problem. Back briefed Investigator Pham. Pham noted that the husband of the victim said Mortensen said he couldn’t put Morningstar on leave because it could be considered discipline, not that the husband asked Mortensen not to challenge Mor ningstar. Briefed Cert Div Manager on all the above. 1635 hours, received call back from LCSO FOB Chief Breen, advised he briefed Undersheriff Wes Rethwill on my message, and said he just heard from vacationing Sheriff Snaza who had gotten call from Mort ensen. According to Breen, Mortensen was calling Morningstar in this evening and placing him on admin leave. LCSO is aware of problem and acknowledged CJTC’s notification. Updated Pham and Devine. He was contracted by City of Morton Mayor to complete a polygraph investigation on Morningstar. He stated that the Mayor put in him a tough place because he had to complete his own inquiry in order to complete the polygraph. Mayor Mortensen stated he was not going to complete an investigation into Morningstar and Morningstar claimed he could pass a polygraph. Dehart further stated that he interviewed a woman that is scared for her life in regards to Morningstar. She was involved in an affair with Mornings tar and she would meet him for sexual activity during his shift.
