What fbllows is that story. We have an interview with Bro. Joe Little who did 18 mos. at Attica and was paroled in Febuary of '72. Joe was picked-up on Dec. 26th and charged with2 counts of assault. He was bailed out on Jan. 2nd and is now back at his job in the South Bronx. We also have a statement from the brothers being held in Auburn. Those brothers who were out on the street were taken to Eire County and those already in Maximum were shipped out to Auburn. Martin Sostre who was in solitary at Auburn was quickly transferred to Cointon Prison [near the Canadian border] when word of the indictments came down Interview "So far there's been 37 indictments. All told 64 people been indicted about 24 of those 64 were on the street. So they were like more of less rounded up and forwarded into jail. Now a lot of the time the P.O. used the tactic of sending the brothers a telegram saying come into the office immediately, a crisis has arose, yaknow. A guy comes in and there are 15 police waiting for him. And know one would tell us what the charges were: What we're being indicted for-they were all sealed indictments, ya know. The grand jury's still meeting supposedly to bring down some more indictments. Yhe Attorney General has implied that some guards are gonna be in dicted, but if so it'd probably be for miscellaneous bullshit charges like maybe obstructing justice like they did with Hanrahan in Chicago: The sahne type of thing just a whitewash and a slap on the wrists and that will be the end of it. "But a lot of the charges are kinda serious; like one brother got 34 counts of kidnap-now that's ridiculous. A lot of the charges are just pure fabrication. 15 guys on one indictment. Half of nobody don't even knows each other. Now they have me on for an assault charge- assaulted two police and one police weighs 300 hundred pounds and I only weigh 140. Like they stayed away from conspiracy charges and inciting to rio type things. They want to make it a pure criminal type thing: murder or rape or arson or kidnapping. They want to keep it purely criminal cause they found out that when they enter the political arena-they blow. They blew wit Ericka, the Panther 21-they lost with all these. And like the state figures they've learned something from these past mistakes. So they're not gonna enter that arena this time. „ T i "Like the way they brought down the indictments. They waited till Christmas time when everybody's involved in the New Years spirit (and they bomb the brothers in Vietnam back to the stone age) and then scoop us up and put us in jail and before you know it it's all over with and we're in jail. And nobody even knows about it. "Nobody knows about what's going on about Attica. The news media has played it down; Also the state is playing it down. Right. In most cases you go to the court room it's like a military garrison. Now in Wyoming County (where the indictments were handed down, ed. note) it's not like this. They haven't militarized it cause this is what the news media likes and that s a story, an the state recognizes this and they're playing the whole thing very low-key so the public won't become in terested. , , "We live in like a sensationalized oriented society. Just like the brother in New Orleans who was taking care of business. For like three or four days it was front page news. Now there ain't a word about it they just forgot about it. They sold papers for a week. Now they squashed it. Just like Rahway it don't get no coverage; Ructell Magee HE don't get NO coverage. Attica, we're not getting any coverage right now-a year ago it was all over the front pages. You know, like the thing is depoliticized so that the public don't become aware of how the charges are being fabricated. Because Rockefeller and the state feels like they got to make somebody out to be the bad guy. I mean like they killed 43 people, right some of those were hostages, you know (or guards really; they were guards). So, they have to justify this. If they don't bring no-one up on criminal charges-like wow: who's the enemy? And maybe like the public will say Rockefeller's the enemy cause no-one got indicted. As long as they indict someone, they don't even have to be found guilty, as long as they indict someone cause people associate an indictment with being guilty. Cause like a lot of people told me, "like, you can't be indicted-hey, they let you out of the joint they can't take you back." And these are some people been in the jail, went through the whole court system and still don't realize the power these idiots possess, you see like if they let you out of jail how can they take you back? THE SAME WAY THEY PUT ME IN THE FIRST TIME. Come and get me. It's no big thing to bring no indictments down. "People in this society don't know nothing about how the thing even functions. They don't know how the ruling class even works-know nothing about the court system; nothing about the big corporate law-they just floating around like a big cork in the ocean. And the public has to be made aware of the power that these fools like Rockefeller (we really shouldn't be calltn' him Rockefeller-should be calling him Rocke-killer cause he is a sho-nuff killer, right?) and Tricky Dick Nixon and his man Kissinger-he's another idiot, you know: These people wield a lot of power; they manipulate a lot of people. *• "People say like you can't be indicted; you can t go back to jail. Why would they let you go if they were going to indict you? That has nothing to do with it. 'Those brothers who were on the street they put in Eire County Jail. Everyone else they put in Auburn. Now the way they were getting the brothers-they would go to a brothers cell and say you got a visit, and when he comes out of that cell: whew: scoop him up; pack up all his shit and put him on a bus going to Auburn. You got to un derstand the mentality, hey you know-you don't know man if they taking you to some underground hole to ice you. They got one brother, they went to the movie; call his name on the loud speaker, right, scooped him up out of the movie and put him on a truck. You know, shackled on down you don't know if you're going to your death; you know like you really don't know cause that's the mentality that you've been conditioned to. Cause you don't know what these people are gonna do. (After being in the 'Yard' and they came in there like gangbusters and just shot up everybody: discriminate AND indiscriminate; some people were marked and some people just got shot, like the guards). Some people have been brought to court like two or three times for different indictments, drag you to court one day take you all the way back to Auburn (about 200 miles) bring you back the next day and all this time you not even eating. You're shackled up on your hands, your feet. Your feet shackled up to your hands. And it's very uncomfortable (they feed you Peanut Butter sandwiches). All this is just part of the whole harassment. One brother they brought down three times. Why couldn't they just open all three indictments at one time? %MS: They tried to keep the brothers isolated from one another? "J.L.: Yes, we put in slips cause we want to get together on the same gallery. The gallery I was on was just me and three other guys. The only way we would get to see each other was when we went to court. And then in court they would try to keep us separated the brothers who were already in a concentration camp-keep them separated from the brothers who were on the street (in minimum security cause like we all in jail). I just left the maximum security for the minimum security; I just got a little mobility, but I'm still in jail qut here too. But they do try and keep us separated...THEY DON'T want know type of communication. 'This is facts: The record of the court will show you that this is facts, you only heard that big black, A#K#A Frank Smith, tore up his indictment and called the supreme court justice Carman T. Ball a member of the Ku Klux Klan. This is true, all of it, now ask why? The answer is not sought by the high and the mighty white racist that live around us for they only want to hear that part. In the court room, a American court room mind you they marched people in with chains on their legs, body, and hands, they read indictments. Big black A#K#A "Frank Smith" hearing things like this and being held in chains since six-thirty a.m. and being carted to the court room from Auburn Segregation Unit, where he is denied his own personal food that his family sent him, being denied his toilet articles and the right to live like a human being, and to see only inmates being brought before this racist court "when in fact the people who fired the guns and killed not only the brothers of Attikkka on the 13th day of Sept. 1971, were not even indicted." What big black A# was saying was the truth, when he called the justice a Ku Klux Klan, he was calling them what they were and are, when he ripped the copy of the indictment up this was true cause he did not and will not accept this lie. Did they tell you the story of the brother named Reed that walked into the court missing one foot, and that he asked the court where is the man that shot his foot off while he was in the "D" yard unarmed, with his hands over his head, surrendering to the Commissioner of Correction who said, "Place your hands on your head and you will not be harmed. No they did not tell you of this but they told your favorite T.V. station that "Edward Dingle who was in the false indictment of 15 72 with big black and six others did call the justice of the Wyoming County Court a member of the Ku Klux Klan "A Grand Wizard" does he not have the right to call a justice this when the first person in the court room Richard Bilello, also of indictment 15#72 lay the claim to the fact that Robert Miles the compaint did in fact state in front of 15 persons that the indictment was false and that he was indicted so he would be made to testify falsely to the peoples indictment 15#72. Why does Fisher not tell the public this? Go to the courtroom and buy the minutes of the court proceedings of the 29th day of December 1972 you will find that you will be in court for every court proceeding thereafter and this is a public court and really your court, why do you think that the Rainbow Family support the Brothers of Attikkka? Why does the Prison Solidarity support the Attikkka brothers? REMEMBER ATTICA 1' G r e e n h a v e n Page 4 Repression "THE PREDACIOUS COURTS OF CLINTON COUNTY" THE LAST OF THE REMAINING AMERICAN REICHS? It has now been over one year since the Attica massacre of September 9th-13th, 1971 at Attica, New York where 43 human beings lost their lives by Nixon's and Rockefeller's state mercenaries. Since then many men who were veterans of that most revolutionary phase of New York prison history have been shipped to other isolated concentration camps "to break up our righteous comrades" and to alienate those who had vital in formation for their lawyers regarding the massacre. Many of the average citizens in the pseudo-free world now read in their daily newspapers and hear over the television and radio news media the so called changes that have occurred since Attica. Prisoners are being provided with new clothes, "greens" as they are com monly called, and are provided with other facilities designated for rehabilitation purposes. Little does the public know that prison conditions have in all reality changed very little, and the ghost of Attica still haunts the prisons all across New York state as well as all American prisons all throughout the United States; and the so-called "rehabilitation facilities" designated for prisoner rehabilitation purposes are actually facilities of genocide for war against the prisoner class. For those of you readers who are unfamiliar with the "Great North Country Concentration Camp" known as the infamous Clinton Prison in northern New York located near the Canadian border. Clinton Prison located at Dannemora, New York is an isolated mountainous area and the state of New York's "strong hold" for political prisoners. Black, Chinaco, and White revolutionaries. Clinton Prison is the smouldering powder keg, the second death trap Attica of New York state which may explode anytime, perhaps even as you read this. Clinton is the ultimate punishment and torture center where the Department of Correction Commissioner Russell G. Oswald and his "Big Brother Spy Staff' decide who shall be sent to Clinton's "Special Housing Unit 14", or other "Special Diagnostic Treatment Centers" for brainwashing shock treatments, lobotomies and permanently disabling doses of chemical mind destroyers all under the guise of rehabilitation! Clinton is rapidly progressing and becoming a well established "Center for Genocide" due to its isolated location, and supported by the courts of this jurisdiction who all participate and support the genocide program. Most of the prisoners that are brutalized and murdered by Der Fuehrer Warden J. Edwin Lavallee's "Goon Squad" are usually residents of New York City and surrounding boroughs, which makes it easy for the administration to keep these men from communicating to their families; or friends and lawyers. As I stared before, the courts of Clinton County as well as the federal district court of this jurisdiction which is headed by Chief Judge James T. Foley, the nazi type judge, a political sanctioning body that is wholly in consort with the Clinton Prison warden and his staff of & Resistance By Cynthia Brown, Rikers Island storm troopers that patrol the segregation and solitary isolation units in a military fashion with helmets, C.S. gas containers, pick and axe handles and sometimes pistols and almost always knives. Many numerous complaints of brutality have gone to the courts via various "letter type grievance complaints", "Writs of Habeas Corpus", and litigations under title 42 U.S.C. Sec. 1983, both in Clinton County and even to the United States District Court for the Northern District of New York; but all such complaints are always denied and the brutality continues with men being placed in psycho strip cells nude, beaten to submission, made to bark like dogs, made to say: "I am a filthy nigger, and I am your slave" or "I am a punk, I am a dog", then others are doped up with drugs for days even weeks or months, while they lie like vegetables on the cold dank cement floors in their own excrement and urine, unable to function like a living human being any longer; while still yet others are run, made to run naked through the cold prison hallways while being beaten with clubs, rubber hoses, and sprayed with a certain type of "tear gas dust" which burns the human skin, not to mention the "prurient interest" rectal frisks under the guise of a weapons search. Regardless of the decision of Wright v. McMann, 321 F. Supp. 127 (N.D.N.Y. 197) handed down by by Judge James T. Foley of the U.S. District Court for the Northern District of New York; which decision held that inmates are not to be treated as animals by being placed in strip cells, beatened and dehumanized in the most vicious manners. Judge Foley puts very little importance on his Page 5 (Continued on Page® Repression & Resistance ( c o n t . f r o m p „ 5 ) own guidelines and rulings as set forth in Wright v. McMann,-because inmates are still being visiously brutalized, subjected to mechanical restraining devices, placed in dark cells, limited food and subjected to such , dehumanizing tortures designed to strip the mind of the will to resist and to perpetuate and enforce a slave. The prisoner is told that he has no right to freedom or dignity ; that he has no inherent value and the courts concede to this when they allow a human being to be the victim of criminal acts committed by prison authorities who are more of a miscreant than the convicted felon. See: Jackson v. Bishop, 404 F. 2d 571 (1968). Corporal punishment should never be used under any circumstances. This includes such practices as hand cuffing to cell doors or posts, shackling so as to en force cramped position or to cut off cir culation...deprivation of sufficient light, ventilation, food or exercise to maintain physical and mental health, forcing a prisoner to remain awake until he is mentally exhausted, etc. All of these concepts fall under the standards of the eighth (8th) amendment to the United States Con stitution; also the fourteenth (14th) amendment due process clause to the U.S. Constitution; but all of these concepts are not recognized in Clinton County as these constitutional concepts are still being violated and the litigations that have gone into the Northern District court pursuant to Title 28 U.S.C.A. & 1343 (3,4); 42 U.S.C.A. 1983 are still being denied under an arbitrary systematic pattern of failure to exhaust state remedies; or failure to exhaust the administrative remedy or failure to state a claim upon which any relief can be granted; so is the arbitrary rulings of denial of Judge James T. Foley Chief Judge of the District court for the Northern District of New York. Certainly when a claim is made of brutality ac companied by other dehumanizing factors which meet the proportionate standards of the eighth amendment which certainly gives the court sole jurisdiction; and no other remedies need be exhausted pursuant to Title 42 U.S.C.A. 1983, why then or better yet, how can a man or woman in prison subjected to brutal oppression exhaust an administrative remedy by appealing to those who are the cause of his or her oppression and the brutalizer? Wright V. McMann, supra, Jackson v. Bishop, supra. It is a fact that Warden Lavallee and his gestapo like staff of cold blooded robots are in indirect contempt of court pursuant to the guidelines as established in Wright v. McMann, supra, N.D.N.Y. A class action has been pending for over .a year in the Northern District Court. All of the representatives of the prison class were not permitted to testify at the preliminary hearing to ascertain whether or not a restraining order would issue. By denying the prison class representatives to opportunity to appear and testify as to the conditions at Clinton, denied the class of a full and fair evidentiary hearing, see generally. Townsend v. Sain, 372 U.S. 293, 83 Sect. 745, 9 L Ed. 2d 77 (1963). In any event inspite of testimony by David Rothenberg of the Fortune Society, Jack Newfield of the Village Voice and other important public figures who witnessed the con ditions at Clinton Judge Foley refused to issue the restraining order and injunctive relief against the tor- turings and gassings of inmates, especially those who are being held incommunicado in special housing unit 14, better known as the "box" or "catacomb of the living dead". Prisoners at Clinton are encouraged by prison guards to assault one another, pipings, stabbings etc., in order to compound the brutality and sectarianism of the prison class and keep the men d'Krided. To further this division the warden Mr. J. Edwin Lavallee coerces the assault victim into pressing charges against his fellow inmate if he wants to make the parole board, then Warden Lavallee executes his political influence by getting the defendant \ prisoner indicted by a grand jury, his grand jury, even without the complaining witness being present at the grand jury! Instead he sends one of his officers and perhaps an examining prison physician whose testimony alone is sufficient to sustain the finding of an indictment, now that's real political pull! After the inmate's indictment he then spends long months in solitary confinement with loss of good time allowances, loss of prison compensation, subjected to coercive interrogations about the assault or whatever crime he is charged with, the goon squads then wring a "confession" out of the prisoner and tape record it for the prosecution, then the inmate is coerced into pleading guilty or face a mock trial and be convicted and given "the max". If an indicted prisoner, whether innocent or guilty, endeavours to assert his rights under the United States constitution, specifically his rights under the sixth amendment for a speedy and public trial, he is denied this, in order to "get rid of the defendant's witnesses" by either shipping inmafe defense witnesses to other prison camps or by releasing them on parole, thus weakening the defendant prisoner's case, and leaving only one option for the prisoner, "cop out". See section 30.20 of the criminal procedure law, speedy trial; section 12 of the civil rights law. Every defendant in a criminal action, whether he be detained in a jail or in a prison is entitled to a speedy trial, sec. 30.20 of the C.P.L. In Smith v. Hooey, 393 U.S. 374, in that case the United States Supreme Court held that a federal prisoner who faces criminal charges in a state court is not by virtue of his incarceration precluded from asserting his right to a speedy state trial. The state is required to honor his demand for a speedy trial by attempting to obtain his release from federal custody for the purpose of trying him. The petitioner in the case at bar had for six years at tempted to obtain a speedy trial on a state indictment. Had he been at large, "the state would have been under a constitutional duty to try him," and had he been a state prisoner during this time, the state's obligation "would have been no less". The fact of his federal incarceration did not relieve the state of its speedy trial responsibility. See also: Klopfer v. North Carolina, 1967, 87 sect. 988,386 U.S. 213,18 L.2d. 332; People v. Prosser, 1955, 309 N.Y. 353,130 N.E. 2d 891. I could go on citing other cases; but here in Clinton County where writs of Habeas Corpus are suspended, law suits and basic human rights are disregarded or denied, a human being then understands that true American liberty as laid down in the constitution and the Bill of Rights is being raped and defiled in the worse way Repression & Resistance by the predacious courts of Clinton County because they have established themselves as the sole power of repression and neo-nazi rule. Here in Clinton County is the last of the remaining American reichs supervised by the murdering high command, Governor Nelson A. Rockefeller, Russell G. Oswald, J. E. Lavallee, all of whose political affiliation and control over the prosecutors, attorney generals and judges make Clinton County a private domain, unrelated to the rest of this state or country, where any "outsider" can fall a victim of pure neo-nazi injustice by merely being caught up in the political webb of some fabricated charge. Unless Clinton County and its neo-nazi rulers, namely Russell G. Oswald, J. E. Lavallee, Judge James T. Foley, Judge Robert J. Feinberg, District Attorney Thomas R. North et al, unless these reactionary miscreants and their system of repression are exposed, the men now confined at Clinton Prison shall meet new and even greater horrors which are presently in the making at the Dannemora State Hospital for the incompentent or insane inmates where political prisoners shall be sent and confined in a maxi-maxi dungeon and shall undergo psychic genocide which comprises a definitive analysis of techniques by n^o-nazi type psycho-surgeons who use tactics that were once used in North Korea brainwashing to induce radical alterations of behavior was was formally used on Americans and other prisoners of war. Dannemora State Hospital is presently selecting men from the prison for the "political prisoner" brainwashing program bphind its closed doors ready to make vegetables out of active human beings under the in terstate agreement act. Prisoners will be received in the special reception center dungeons of Clinton Prison, doped up, coerced, and forced to sign papers for psycho-surgery and for their transfer to the "Diagnostic and Treatment Center." Even if the political prisoner refuses to sign, which is ' unlikely under the influence of mind destroying drugs, the court in Plattsburgh, New York will certify the political prisoner as being insane and thus sending the political prisoner "over the wall". Under the interstate agreement there are no procedural safeguards written into the agreement where by a prisoner can legally challenge in the courts a transfer to the "genocide factory." Unless we get the support of the people; unless we unite our forces of revolution against the death dealing neo-nazi reactionary forces of oppression, we shall all go like lambs to the slaughter, because the time is running out. Too many lives have been needlessly spent, because of our passive attitudes, ft's time we became angry, let us unite under one common bond and fight! All power to the people! For thelast 10 years, the Black Man in America has stopped talking about his equal rights and human rights. He has been struggling on all levels and in all areas, for his very survival. The fascist ruling class has made many small compromises, and moves to keep this movement (the struggle for survival) in check. However, the effect has been to delay the on rush of a mass movement, but not check it. As long as 30 years ago, a new type of fascism was developed here in America; a middle of the road, liberal type of fascism, bringing with it the concept of a welfare state (i.e., a non-productive group lives off the labor of the productive groups). In looking at the history of America, we will see that the concept of this ideal welfare sate, represents everything the American masses have been programmed to hate. To better un derstand the reasons behind this move, we need to look at the basic reas'ons fascism comes into being. There is the need for reforms, economical reforms; a need to off set the large scale unemployment that follows every group. Under the concept of patriotism (Americanism in this case), anyone siding with the scapegoats become an enemy of the state. All those against the scapegoats are viewed as super-patriots (such as The National States Rights Party, The Minute Men, The American Nazi Party, the KKK, etc..ect.). At some point the fascists, through mass propaganda, try to put across a concept; the only solution to the many problems is: The complete removal of this non-productive, anti-social, unpatriotic group (the scapegoats). Simultaneously with the mass propaganda comes the systematic preparation for GENOCIDE of the target group; massive legal repression, vicious police raids and arrests, planned influx of drugs, systematic elimination from jobs of importance, locking up of all the men of fighting age (those who are not already dying in one of their unjust wars), starting with the most rebellious groups first, and many other murderous plots, i.e., ill housing, ill food, ill clothing, lack of medical services, birth control, ect. ect. We can all see this happening today in amerikkka. We all know without a doubt, that the Black Man is the scapegoat in this genocidal plot. The point however, can be summed up like this: 'The fascists ahead with their master plan, but the Black Man Repression & Resistance Rahway, N.J. 'The situation in Rahway State Prison has reached a point of very low ebb. The effects of the political chess game that has been played, with the lives of the prisoners at Rahway, since the "Thanksgiving Day Riot" has in no way gotten better, in fact it has gotten worse. "It took a riot, with the results of many people being hurt, to induce the Governor, and people in the community to take a long hard look into the Rahway situation. However, the Governors view seems to have become distorted some where along the line. And since, for the most part, the community sees the prison situation through the eyes of the Governor and his arbitrators, their view also may become distorted in observing the totalitarian administration which we, Rahway Prisoners, are forced to live under. 'The Governors "Committee" last met with the Com mittee with Inmate Grievances in the month of April, since that time they have not returned. To the unaware public this may seem correct; to the prisoners of Rahway it was the physical manifestation by which the Governor showed his lack of concern for our unjust living con ditions and the dehumanization to which we're sub jected. As will be shown, this was but the first of many such moves. "In the month of December the "State appointed an ombudsman." He is suppose to be an investigator, with "unobstructed access to that which he investigates." Yet he was not given a sufficient staff to aid him in his in vestigation. For access to staffing and the power to correct "our situation" he would need to go to the Commission of Institutions and Agencies; the string to ' which this Commission is attached is held by Governor Cahill. Therefore, we doubt that the ombudsman will be effective, even if he wants to be. "As hard as it may be for some to believe, a Coup da tat has been pulled off in Rahway Prison; as we all know this is a deliberate violation of "Constitutional" rights which are suppose to be held by all people, we are people! The Inmate Committee has been ripped off, that is to say, the Inmate Committee which was originally voted in by the prisoners of Rahway. They are about to be replaced by one of the administration's choice. The election, if we must call it that, which has recently taken place was set up in such a way that the administration had the final say so; hence, the Coup da tat. 'The administration hardly waited for the Governors Committee to leave before they began to suppress us and our legitimate grievances. This is hard to believe, but true nevertheless. The food has become worse, living con ditions are filthy and proper medical care is a thing often hoped for, but seldom received. If the Governor did anything to improve the disposition of the parole board, we here in Rahway have yet to see it. Racism and ar bitrary punishments are paramount among the officers. "Since the so called "Prison Reform Movement has not worked we ask: what will it take to change our situation? What will it take for the administration to realize that we are men and wish to be treated as such? What will it take to improve our living condition and the way in which we're viewed by the parole board?
