AFFIDAVIT OF CONFESSION OF JUDGMENT RUSSELL SIMMONS affirms, under penalties of perjury under the law of New York, which may include a fine or imprisonment, and pursuant to 28 U.S.C. § 1746, and declares that the following is true and correct: 1. I am fully authorized and have full power and authority to enter into, execute, perform, and implement this affidavit that authorizes the entry of judgment by confession in New York, New York. 2. I hereby confess judgment in favor of Wendy Carolina Franco ("Claimant"), having an address of c/o Emery Celli Brinckerhoff Abady Ward & Maazel LLP against myself in the sum of Five Hundred and Fifteen Thousand Dollars ($515,000), less any payments received by Claimant from me after October 1, 2023, plus statutory interest thereon at nine percent per year for each day beginning on and inclusive of the date of entry of judgment until said amount (the "Confessed Amount") is paid, together with all costs, expenses, and fees, including reasonable attorneys' fees incurred by Claimant (or her estate, heirs, successors or assigns) in connection with any efforts to enforce this confessed judgment or any lesser amount against myself, my heirs, executors, administrators, and assigns. 3. I hereby authorize Claimant, as well as her heirs, executors, administrators, or assigns, to enter judgment in any court of competent jurisdiction for the Confessed Amount. 4. This Confession of Judgment is legal, valid, and binding on me and enforceable against myself, my heirs, executors, administrators, and assigns in accordance with its terms. 5.
