Dear Mr. Brooks, Thank you for taking my call this morning. Here is an outline of our case. Upon the advice of 2 NW AR attorneys, who have previously worked for the Eureka Springs City Advertising and Promotion Commission ( CAPC ), and are unable to again represent us (because our main problem person (or his employer) are clients), I have been advised that if/when an entity/person (even a newspaper) involves themselves, particularly if there is a financial gain involved, in going far beyond criticism/FOIA requests and begins harassing persons/entities and/or or purposefully smearing them (to the point that their careers/reputations are irreparably damaged; AND it can be proved, that/those entities/persons are guilty of a criminal act(s) which are punishable under the law. Ms. Lacey Ekberg, CAPC Director and the CAPC itself, as well as some members of our Commission and some Employees have been harshly harassed and publically (in the Carroll County News/Berryville/and MO) painted with this untrue paintbrush – more like tar and feathering our Director...things like threatening to FIRE employees not under their care, on a regular basis. These employees, including Ms. Ekberg have good performance records. Lacey has done an outstanding job and received a stellar 90-day review. Rick Woods who directed me to you is checking within his firm, and without, perhaps, for an attorney who may be able to represent us, but we need to move ahead on an investigation of one person in particular, with the potential to investigate 2-3 others who are a part of the cabal. There is a history with the ring leader, Jack Moyer, GM of the Crescent and Basin Park Hotels including a bankruptcy when he purchased a hotel in Harrison, used Crescent/Basin Park staff/materials to get it up and running and lost it (the over $1M loan was to Cornerstone Bank – owned by John Cross, now run by his son, Charlie Cross, John’s daughter/Charlie’s sister is on the CAPC and is supportive of fact -finding and upset, as are most of us, that our Director, Lacey Ekberg has been maliciously attacked). Elise and Marty Roenig (hotels’ owners), I’ve heard, were ready to prosecute Jack, but Marty was killed in a car accident (Elise was driving). She has been in deep grief ever sense with no will to confront Jack. Jack is married with a college aged daughter. He has had numerous affairs (including employees) and there are many people, including some of these women who truly hate him. I recently heard that Jack and his wife (Jennifer?, who works at Clear Springs School, although holds a PhD in Economics (?)) conned the people that own a $7M property in town – can get more info in this. In my opinion, Jack is less about the money and WAY about his ego/power. He’s predictable in many ways and not very shy about what he is doing – we have him on tape at our last public meeting that he is running advertising, etc. for Eureka Springs. This is the sole mandate of the CAPC, not his. We have to be responsible to ALL our tax collectors (restaurants/hotels), our town, and be fair to all – he truly thinks he is so smart/ experienced that he can do this better than us and has taken his jealously of not having control of our budget out on many people. There is also a GREAT DEAL of information about skimming at the hotels he manages. I believe that as a tax agency we are not getting our fair % of AR State Taxes that are to come to the CAPC to pay for the best advertising to bring in tourists from “outside” Eureka Springs, not to mention his alleged theft of funds from Ms. Roenig. This same group (below) has run off our former, brilliant Director, Mike Maloney, Cave Springs resident, now working for another local agency. They have taken over the Chamber of Commerce which is in terrible debt, and they also smeared and poorly treated their past 2 directors, including gross misrepresentations of them personally and professionally – Mr. Miller and Tammy ? would probably be very happy to talk to you, as might Mike Maloney. I believe it (and he has stated it) that it is Mr. Moyers’ intention to take control of the CAPC (a State Tax Agency) to be able to direct our approx. $1.5M budget to benefit himself and his places of work – he has also, recently, purchased his own lodging – Loblolly Pines Inn – on Highway 62/Eureka Springs – no doubt Crescent/Basic Park staff/materials were used to bring this property up to a better standard. While this is not our immediate concern, Jack appears to be setting up people to take over, not only the CAPC staff and Commission, but also C ity Hall (Alderpersons) and the Mayor’s job. Jack’s situation at the Crescent/Basin Park is coming to an end as his employer, Elise Roenig (a really philanthropic/dependent woman/she lives at the hotel) is elderly and ill. Elise probably knows Jack is skimming, probably is unaware of the tax issues that could cause her to lose the hotel. I have heard that she hates Jack and plans to leave the hotel to her brother (who definitely hates Jack) when she passes. Jack will lose his job at that time and may even be trying to wheedle control from her – as I said she is elderly and ill and I would not put this past him. Elise’s brother would probably love to annihilate Jack from all I’ve heard. He and his wife run a cute pet store in the Basin Park Hotel. He will be protective of Elise, but there is no love lost for Jack. He will want to protect Elise, but will be concerned about the potential loss of value re: the taxes. There are others that are a part of this small, but venomous group as follows: 1. Tom Rask, EurekaSprings.com – candidate for our Director job/$30K ann. Vendor Crescent – trying to blackmail CAPC to buy his site for $70K. Lives in FL, probably on the spectrum – odd! 2. Bob Moore, Publisher, Carroll County News, maybe Arian Nation connections, friend of John Cross, also a White Nationalist type person. 3. Scott Loftis, Editor, Carroll County News, OMG look up his website proclivities – Hurt Websites – woman hater – 2 BKs one recent – filthy person! 4. Damon Hinkey, understand he has 2 domestic abuse felonies (OK ), carpetbagger, Jack’s lackey 5. Jacqueline Wolven, Main Street leader, using non-profit to pay her salary, truly hated person in town – probably bi-polar as unpredictable. 6. Susan Harman, local B&B Owner, CAPC & City Council, she can be FOIAed - desperate to sell her place, hates Eureka, Jack sends her, first, all his overflow business. Her taped/televised actions are obvious. Jack used her, as then Chair, to run Mike Maloney off, the former Director. There are a few other minions, but the first 3 are at issue and we have recently connected them through an e-mail Mr. Rask sent – basically showing that a FOIA(s) Mr. Loftis asked for, were followed up upon by Mr. Rask in FL, who is not a PI, but is acting as one. They got access to Ms. Ekberg’s employee file and twisted a time-off request to inter her Mom/Brother as a con-job against a former employer – beyond the pale, right? These are cruel people that do not have the best interests of ALL Eureka Springs in mind – totally selfish, and, as their business acumen shows, VERY POOR business leaders besides. At this point in time, you would be working for me. There are several interested/injured citizens who have an interest in, and are financially supporting this effort. At some time, this might become a case for the CAPC and/or Lacey as there has been personal, financial and career damage done to our newly hired (6 months) Director who is being laid-off, but continuing to work as a Contractor as there is NO EVIDENCE/PROBLEM with her performance. Employees and Commissioners are also harassed and damaged by this, not to mention our wonderful town. I am happy to discuss this further with you. There are other Commissioners that can meet with you, some who know where ALL the bodies are buried, being in town for many years. Ethical and caring people who want the best for our home. We are prohibited to meet in small groups about anything upon which we might vote, state law. Of course that makes working in tandem harder, which these adversarial people certainly use.. Again, I think you for taking my call and hope that after reading this you will consider working with us. You, of course, might have a better idea of how to approach this, we need to be careful with our money. Frankly, I’d love to see Lacey return to us as she has made such a positive difference in only 6-months here.
