Terms of Service Lee SurveillanceE ff ective Date: May 3, 2025 These Terms of Service (“Terms”) govern the provision of professional perimeter inspections, wellness checks, and customized property monitoring services (“Services”) by Lee Surveillance to clients (“Client” or “You”) in Muskegon County and Ottawa County, Michigan. By engaging our Services, you agree to be bound by these Terms. Please review them carefully. 1. Scope of Services Lee Surveillance provides the following Services, as detailed on our website (https:// leesurveillance.carrd.co/): • Routine Perimeter Checks: Exterior inspections of residential or commercial properties to identify and report visible security issues. • Elderly Wellness Check-Ins: Non-intrusive visits to con fi rm the well-being of elderly individuals. • Nighttime Surveillance (Add-On): Optional exterior monitoring during nighttime hours, available for an additional fee. • Vacation & Seasonal Property Monitoring: Scheduled exterior checks for properties during owner absences, including vacation homes and short-term rental listings. • Custom Plans: Tailored monitoring schedules based on Client speci fi cations. Limitations: • Services are strictly limited to exterior inspections. • Lee Surveillance does not provide emergency response services. In case of urgent issues (e.g., suspected trespassing, property damage), we will notify the Client and/or appropriate authorities as outlined in Section 5. • Services are provided only in Muskegon County and Ottawa County, Michigan. 2. Eligibility To engage our Services, you must: • Be at least 18 years old and have the legal capacity to enter into a contract. • Own or have legal authority to request monitoring for the property or individual(s) involved. • Provide accurate contact, property, and billing information. 3. Service Agreement • Booking: Services are booked through our website (https:/leesurveillance.carrd.co/) or other designated methods. You will receive con fi rmation of the service scope and schedule upon booking. • Scheduling: Routine checks and wellness visits are scheduled in advance. Daily check-ins are available for custom plans, subject to availability. • Modi fi cations: Requests to modify service schedules or plans must be submitted at least 72 hours in advance and are subject to our approval. • Service Area: Services are exclusively provided in Muskegon County and Ottawa County, Michigan. 4. Fees and Payment • Pricing: Fees are based on the selected service plan and con fi rmed at booking. Nighttime surveillance incurs an additional fee. • Payment Terms: Payment is due in full upon booking for one-time Services or monthly in advance for recurring plans. Accepted payment methods are speci fi ed at booking. • Late Payments: Overdue payments may incur a late fee of 1.5% per month on the outstanding balance, to the extent permitted by Michigan law. • Refunds: Services are non-refundable once performed. Cancellations with at least 72 hours’ notice may be eligible for a partial refund, less a 10% administrative fee. 5. Incident Reporting • Noti fi cation: If we observe potential issues (e.g., property damage, suspicious activity, or wellness concerns), we will promptly notify you via your designated contact method (e.g., phone, email, or text). • Authorities: In cases of suspected illegal activity or immediate safety risks, we may contact local law enforcement or emergency services and notify you as soon as practicable. • No Liability for Third-Party Actions: Lee Surveillance is not responsible for resolving issues or for the actions of third parties, including trespassers or emergency responders. 6. Client Responsibilities You agree to: • Provide accurate property details, access instructions (if applicable), and emergency contact information. • Notify us promptly of changes to property status (e.g., occupancy, renovations) or wellness check requirements. • Ensure the property complies with local laws and regulations to facilitate lawful monitoring. • Maintain clear access to exterior areas for safe and e ff ective Service delivery. 7. Termination • By Client: You may terminate recurring Services by providing 30 days’ written notice. Prepaid fees for unperformed Services may be refunded, less a 10% administrative fee. • By Lee Surveillance: We reserve the right to terminate Services at our sole discretion with immediate e ff ect, including but not limited to cases where: • You provide false or misleading information. • Your actions or property conditions interfere with our ability to perform Services safely or legally. • We determine, in our sole judgment, that continuing Services is not feasible or appropriate, regardless of payment status. • E ff ect of Termination: Upon termination, all outstanding fees become immediately due, and Services will cease. No refunds will be issued for Services terminated by Lee Surveillance under this section. 8. Limitation of Liability • No Guarantee of Outcomes: Lee Surveillance does not guarantee the prevention of property damage, theft, or other incidents. Our Services are limited to observation and reporting. • Maximum Liability: To the fullest extent permitted by Michigan law, our liability for any claim arising from the Services shall not exceed the total fees paid by you in the preceding 12 months. • No Consequential Damages: We are not liable for indirect, incidental, or consequential damages, including but not limited to loss of property, revenue, or emotional distress. • Force Majeure: We are not liable for delays or failure to perform Services due to events beyond our control, such as natural disasters, government restrictions, or severe weather. 9. Indemni fi cation You agree to indemnify, defend, and hold harmless Lee Surveillance, its employees, and agents from any claims, damages, or liabilities arising from: • Your failure to provide accurate or complete information. • Unauthorized use of our Services for your property or individuals. • Third-party claims related to the monitored property or individuals. 10. Privacy • Data Collection: We collect only the information necessary to provide Services, such as contact details, property addresses, and wellness check preferences. • Use of Data: Your information is used solely for service delivery, scheduling, and communication. We do not share your data with third parties except as required by law or to contact authorities in emergencies. • Security: We implement reasonable measures to protect your data but cannot guarantee absolute security. 11. Intellectual Property All content on our website, including logos, text, and service descriptions, is the property of Lee Surveillance and protected by U.S. and Michigan copyright laws. You may not use our content without prior written permission. 12. Governing Law and Dispute Resolution • Governing Law: These Terms are governed by the laws of the State of Michigan, without regard to con fl ict of law principles. • Jurisdiction: Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Muskegon County, Michigan. You consent to the jurisdiction of such courts. • Attorney Fees: In any legal action to enforce these Terms, the prevailing party shall be entitled to recover reasonable attorney fees and costs, as permitted by Michigan law. 13. Amendments We may modify these Terms at our discretion. Updated Terms will be posted on our website (https://leesurveillance.carrd.co/), and continued use of our Services constitutes acceptance of the revised Terms. We will notify you of material changes via email or during booking. 14.
