(S . 4 f . ) Fehr b e g in n t s e in e h is t o r is c h e Rückschau m it B e r ic h te n T a- c i t u s 1 von g e rm a n isch e n Z w eikäm pfen, d e re n Ausgang a ls A u s p i־ cium f ü r den Ausgang e in e r S c h la c h t angesehen w u rd e , und m it a lt e n n o rd is c h e n Sagen, d ie von Zweikäm pfen "um den B e s itz e in e s W e ib e s, um G ru n d s tü c k e , um Gut und Ge ld " e r z ä h le n , nach dem M o tto "D e r S ta rk e h a t das R e c h t!" D er g e r i c h t l i c h e Zw eikam pf des M i t t e l a l t e r s z e ig te schon g e w isse M erkm ale des modernen D u e lls : d e r G ru n d sa tz d e r E b e n b ü r t i g k e i t w ar s t a r k a u s g e p rä g t, n u r A n g e h ö rig e g le ic h e n S tandes k ä m p fte n m ite in a n d e r ; n u r d e r f r e i e und r e i n e Mann w ar zum Kampf z u g e la s s e n : gegen K nechte und s o lc h e , d ie d u rc h " M e in ta - te n " ih r e n Namen b e f le c k t h a tte n , kä m p fte man n i c h t ( S a t is f a k - t i o n s f ä h i g k e i t des modernen D u e lls ) ; im s ä c h s is c h e n R e ic h s g e - b i e t mußte d ie K am pfklage von e in e r b e le id ig e n d e n H andlung b e - g l e i t e t s e in - V o ra u sse tzu n g des Kampfes w ar e in ( n ic h t w id e r - r e c h t l i c h e r ) A n g r i f f a u f d ie Ehre des G e g n e rs ;1 auch d ie F o r m a l i t ä t e n des O rd a ls e n ts p ra c h e n i n Manchem dem modernen D u e ll: b e id e Käm pfer wurden g le ic h m ä ß ig b a n d a g ie rt und m it W affen a u s g e r ü s te t; b e id e bekamen e in e n S ekundanten, d e r n u r i n ganz be stim m te n F ä lle n e in s p r in g e n d u r f t e ; L ic h t und S c h a tte n waren so zu v e r t e i l e n , daß k e in Käm pfer im V o r t e i l w a r; im K a m p frin g wurde F rie d e n g e b o te n , und a u f B e fe h l des U n p a r- t e iis c h e n , des R ic h t e r s , begann d e r Kampf. D e r S tä rk e re h a tte das R echt im R ücken, ohne daß noch e in u n - m i t t e l b a r e r S ch u tz G o tte s angenommen w u rd e . D er R ic h t e r f ä l l t e nach dem Kampf das U r t e i l , gegen das es k e in e A p p e lla t io n gab. In S c h w ä b is c h -H a ll (Kam pfordnung von 1544) w aren n u r noch r i t - te rs m ä ß ig e Le ute z u g e la s s e n . Kam pfgut w ar d ie E h re . Kampfsachen w aren B e le id ig u n g e n und s o n s tig e S t r e i t i g k e i t e n . D ie Idee des Beweises t r a t h i e r z u rü c k h in te r _ d e n Gedanken, f ü r e in e e r l i t t te n e E h r v e rle tz u n g Genugtuung zu bekommen. Das G e r ic h t w ar n u r noch Z uschauer und S c h irm e r des K a m p fp la tz e s . D er Kampf w ar E n d zweck und g in g a u f Leben und Tod. I n d ie s e n K a m p fg e ric h te n o f f e n b a r t s ic h e in e d e u t lic h e Ü ber- g a n g s s tu fe zum D u e ll. "N u r d u rc h das I n s t i t u t d e r K a m p fg e ric h - te " g e h t nach Fehr das D u e ll a u f den O rd a lz w e ik a m p f z u rü c k .
